Minutes - Board - 1983-06-09_ - �'� • MINUTES OF THE REGULAR MEETING BOARD OF DIRECTORS COSTA MESA SANITARY DISTRICT June 9, 1983 Call to Order The regular meeting of the Board of Directors of the Costa Mesa Sanitary District_ held jointly with the Board of Directors of the Orange County Sanitation District No. 6, was called to order by President Wahner at 7:30 p.m. Roll Call Present: Directors - Wahner, Crank, Hutchison, Hanson, Green Absent: Directors - None Officials Present: Bruce Mattern, Manager Robert Oman, Finance Director Roy June, Attorney Rob Hamers, Engineer Florine Reichle, Assistant Secretary MINUTES On motion by Director Crank, seconded by Director May 12, 1983 Green, and unanimously carried, the minutes of the regular meeting of May 12, 1983,'were approved as distributed and posted. PUBLIC HEARING Chairman Wahner announced that this was the time Liquid Waste and the place for the public hearing on the Disposal Fee liquid waste disposal fee to be assessed by the Costa Mesa Sanitary District. He pointed out that the Ordinance was adopted at the Board meeting of May 12, 1983, ordering the preparation of a report and the setting of a public hearing and that this Ordinance was published in the Orange Coast Daily Pilot as required by law. He also announced that the Notice of Public Hearing for June 9, was published in the Orange Coast Daily Pilot as required by law and that written notice of the public hearing had been mailed to each owner of property within the District, also as required by law. Chairman Wahner then requested Wayne Sylvester.of Sanitation District No. 6 to present a factual background of the need for the Assessment District and Mr. Sylvester made a verbal presentation which was followed by a slide presentation. Mr. Sylvester then Written Protests announced that seven written protests to the Received charge for liquid waste disposal had been received and it was moved by Director Hanson, seconded by ® Director Crank that the written protests be MOTION received and filed. Motion carried by the follow- ing roll call vote: PUBLIC HEARING AYES: DIRECTORS: Wahner, Crank, Hutchison, (Continued) Hanson, Green NOES: DIRECTORS: None • ABSENT: DIRECTORS: None Verbal Protests Chairman Wahner then announced that the public Heard hearing, being opened, the Board of Directors of the Costa Mesa Sanitary District would hear verbal protests to the liquid waste disposal charge, if any. Seventeen persons spoke in opposition to the liquid waste disposal charge and at the close of the public hearing, Chairman Wahner ordered a five - minute recess. Upon reconvening, Chairman Wahner asked for Staff responses to some of the complaints expressed by those making verbal pro- tests and at the conclusion of these responses, the Board was presented with a revised proposed Fees Revision fee schedule, being a revision of those proposed fees presented to the Board in the original report MOTION ordered by Ordinance No. 17. It was moved by Director Hanson, seconded by Director Hutchison that the report be revised in accordance with the new proposed rates submitted by the Staff. Motion carried by the following roll call vote: AYES: DIRECTORS: Wahner, Crank, Hutchison, Hanson, Green • NOES: DIRECTORS: None ABSENT: DIRECTORS: None The Board determined that there were 23,841 parcels of property to be subject to the liquid waste disposal charge and that, according to law, over fifty.percent (50 %) of this number needed to protest the liquid waste disposal charge in Ordinance No. 18 order for it to be defeated. The Board found Adopted that the combined written and verbal protests totalled twenty -four, far short of the required number for a defeat of the liquid waste disposal MOTION charge. Director Crank made a motion, seconded by Director Hanson that Ordinance No. 18 be adopted, finding the protests to be numerically insufficient, approving the report as modified, and ordering the Clerk to file a copy of the report and map to the County Auditor. Motion carried by the following roll call vote: AYES: DIRECTORS: Wahner, Crank, Hutchison, Hanson, Green NOES: DIRECTORS: None ABSENT: DIRECTORS: None • ZPAI ADJOURNMENT • • At 11:06.p.m., because of the lateness of the hour, it was moved by Director Hanson, seconded by Director Green, and unanimously carried that the Board adjourn to Monday, June 13, 1983, at 7 :00 p.m., at which time the balance of the agenda would be considered.
