Ord 2012-94 • ORDINANCE NO. 94 AN ORDINANCE OF THE COSTA MESA SANITARY DISTRICT AMENDING CHAPTER 10.01 OF THE DISTRICT'S OPERATIONS CODE WHEREAS, in 1994, the Board of Directors deemed it prudent planning and risk management to create a safety/loss control committee and adoption of a safety manual; and WHEREAS, in 2010, the Special District Risk Management Authority conducted an Occupational Safety and Health Program Review that recognized a need to update the District's policies and procedures for compliance with current standards; and WHEREAS, the Board of Directors desires to provide up-to-date policies and procedures for compliance with SDRMA and CaIOSHA; NOW, THEREFORE, the Board of Directors of the Costa Mesa Sanitary District does hereby ORDAIN as follows: Section 1. That Chapter 10.01.020 of the Costa Mesa Sanitary District Operations Code is hereby amended to read: "Section 10.01.020.Safety Measures. The Board has determined that prudent planning and risk management require the adoption of a safety manual in compliance with the Special District Risk Mangement Authority as well as the California Department of Occupational Safety and Health current standards." Section 2. That Chapter 10.01.030 is hereby amended to the Costa Mesa Sanitary District Operations Code to read as follows: "Section 10.01.030.Safety/Loss Control Committee. A safety/loss control committee, as per the District's safety manual, shall be formed consisting of the appropriate supervisory personnel to conduct investigations when an industrial incident/injury has occured to determine fault and future mitigation measures. The committee shall meet when an industrial incident/injury has occurred. Minutes of said meetings shall be kept." Section 3. Should any part, clause or section of this Ordinance be declared by any Court of competent jurisdiction to be invalid, the remaining provisions of this Ordinance Ordinance No.94 Section 3. Should any part, clause or section of this Ordinance be declared by any Court of competent jurisdiction to be invalid, the remaining provisions of this Ordinance shall nevertheless be and remain in full force and effect and the Board of Directors of the Costa Mesa Sanitary District of Orange County, California, hereby declares that each and every section, clause, provision or part of this Ordinance would have been adopted and made a part of this Ordinance without the adoption of any portion thereof and that the invalidity of any part or provision hereof shall not in any way affect the validity or enforcement of the remaining provisions of this Ordinance that may stand on their own. Section 4. Pursuant to Health and Safety Code Sections 6490 and 6491.3, the District Clerk shall cause this ordinance or a summary thereof to be published in a newspaper of general circulation printed and published in the District according to law.
