The Board of Directors of the Costa Mesa Sanitary District
met in adjourned regular session at 7:40 p.m., May 20, 1970,
at the City Hall, 77 Fair Drive, Costa Mesa, California,
having adjourned by order of the Board of Directors at its
regular session of May 6, 1970. A copy of the notice of
adjournment was posted and delivered as required by law.
The meeting was called to order at 7:40 p.m. by President
Porter.
Attorney June introduced the representatives present from
Scholz Homes, Inc. and the City of Newport Beach as follows:

to annex 8.232 acres of their apartment project located on

the southeast corner of Superior Avenue and Hospital Road, in
unincorporated territory. At that time the Board agreed
to consider serving the area through a Sewer Service Con-
tract, rather than annexation. The District is trying to
conform its boundaries so eventually it can merge with the
City of Costa Mesa. Subsequent to the meeting of May 6,
Attorney June drafted a proposed Contract which provided
for sewer connection fees, a one -time charge for engineering
and administrative costs, and an annual charge for services.
In the interim, the District was contacted by the City of
Newport Beach requesting that the District refuse to enter
into a Sewer Service Contract with Scholz Homes; Inc.. as
the City of Newport Beach is willing and able to provide
sanitary sewer services, through annexation.
At this time President Porter.asked to hear from the repre-
sentatives from Scholz Homes, Inc.
Mr. Peckenpaugh stated he was surprised to hear about the
letter from Newport Beach and they were not contacted
beforehand so any misunderstanding could be eliminated.
Therefore, he would like to hear from the City of Newport
Beach.
Mr. Wilson stated that a meeting was held in March of this
year with representatives from Scholz Homes regarding annex-
ation to Newport Beach. At that time Scholz Homes was not
the owner of record, and the signature of the owner of record
is necessary, under the law, in order to proceed with an
annexation. It was stated that Mr. Cagney, the owner, now
indicates his willingness to annex this property. The City
of Newport Beach is ready to serve this area in all respects,
after annexation.
A representative from Scholz Homes stated the primary problem
is the time factor. He also mentioned that annexation to
Newport Beach would involve a long time, and there were addi-
tional engineering problems as well.
Attorney June asked if Newport Beach could agree to serve them
through a sewer service Contract basis until the annexation
was completed. It was stated this would take City Council
approval. It was also mentioned that the parking requirements
in the County are below the standards of Newport Beach; there-
fore, it was asked if the District did enter into this Contract
to serve the Scholz homes project if the District would require
• them to meet the standards of Newport Beach regarding parking
requirements.

• The Board decided that more time was needed to study the
various problems involved. It was asked if a week would
be sufficient time to allow the representatives from
Newport Beach to get with the Scholz Homes people. This
was agreed upon by all parties.
Upon motion by Director Glockner, seconded by Director
Warren, and unanimously carried, the meeting adjourned
at 8:45 p.m. to Wednpzday, May 27, 1970.
