Special called meeting of Board of Directors of Costa Mesa Sanitary
District held at office of Attorney LeRoy P Anderson in Costa Mesa
California at 7:30 P M Wednesday June 28th 1944
Directors present: Nelson Dodd Lord and Norman
Absent: TeWinkle
Also present: Attorney Anderson and Secretary Oven
Director Nelson chosen President pro tern
Attorney Anderson explained at length and indetail the
proceedings of the continued hearing on protest set for
2:00 P M this date before the Board of Supervisors and his
appearance on behalf of the Board of Directors for the pur-
pose of requesting a further extension of time of two weeks
in order to permit this Board of Directors to meet and
take action with respect to further answer to the Protest,
it appearing that the Board of Supervisors having viewed
the.dump site were desirous of an expression from the Board
of Directors as to a time limit being applied to Use Permit
heretofore granted and other features affecting the conduct
and operation of the dump. This the Board of Supervisors
declined upon strenuous objection on the part of protestants
�. to grant, but did grant an extension of time of said hearing
for one week, or until Wednesday July 5th at 2:00 P M
Attorney Anderson further stated that in the event of the
present Use Permit being upheld by the Board of Supervisors,
and continued use of the dump made by the Sanitary District,
the only legal action open to protestants as against this
Board of Directors or the District would be that of right
of injunction against further use on the plea that such use
and operation constituted a nuisance under the.law.
It was then moved by Dodd seconded by Lord that a letter of
the form and substance of that attached hereto and made a part
of these Minutes be addressed to the Board of Supervisors of
Orange County California, and further that a Resolution of
the form and substance of that also attached and made a part
of these Minutes authorizing and directing the Secretary of
this Board to affix his signature to such letter, be adopted.
Votes, Ayes: Nelson Dodd Lord and Norman. Noes: None
Absent: TeWinkle. Motion carried unanimously.
Moved by Lord seconded by Norman, meeting adjourn. Carried
