INDEMNITY AGREEMENT
The indemnification and hold harmless provided in THIS AGREEMENT extends to
the County of Orange fee owner of the subject propert' and Steve Lane Lessee
thereof and is limited to the Costa Mesa Sanitary District Project numbered 136
entitled 'Access Road Along Newport Beach Golf Course
Costa Mesa Sanitary District (the 'DISTRICT' ) hereby agrees to protect
defend indemnify and hold the County of Orange (the 'COUNTY' ) and/or Steve Lane
( 'LANE' ) their elective boards officers agents and employees harmless _ran and
against any and all attorneys fees costs expenses or damages of any nature by
reason of injury sustained by any person including death at any time resulting
therefrom, or by reason of loss of loss of use of injury to or destruction of
property including consequential damages of any nature resulting therefrom, arising
out of the above work of improvement by or on behalf of COUNTY and/or LANE including
damages occasioned by or allegedly occasioned by joint or contributory negligence or
omission or affirmative acts in connection with supervision or direction of the work
by DISTRICT its elective or appointed board officers agents or employees
The provisions of the foregoing paragraph shall in no event apply to damages
occasioned by the sole negligence of COUNTY or LANE their elective boards offi-
cers, agents or employees
DISTRICT further agrees to protect defend indemnify and hold COUNTY and
LANE harmless from and against any and all obligations and liabilities under any
statutes laws or regulations pertaining to provisions of a safe place for the em-
ployment of workers (Safe Place Statutes) or any similar statutes laws or regula-
tions with respect to injury sustained including death at any time resulting
therefrom, by ay employee of DISTRICT DISTRICT s subcontractors or others perfor-
ming under THIS AGREEMENT on behalf of DISTRICT
