GENERAL RELEASE OF ALL CLAIMS
BY THIS LNSTRUMENT. Norman Blaine Miller,hereinafter referred to as
'Releasor" for sole consideration of one hundred fifty dollars($150)to be paid to
Releasor, does hereby and for his heirs,executors, administrators, successors, and assigns
release acquit and forever discharge CEDRO CONSTRUCTION INC. and the COSTA
MESA SANITARY DISTRICT its officers, agents or employees from any and all claims
actions, causes of actions, demands,suits,rights, damages, costs, loss of service,
expenses and compensation whatsoever,which Releaser now has or which may
hereinafter accrue on account of or in any way growing out of any and all known and
unknown, foreseen or unforeseen BODILY and PERSONAL INJURIES and
PROPERTY DAMAGE and the consequences thereof resulting or to result from the
accident,incident, casualty or event which occurred on or about the 2od day of February
2000, at or near intersection of Fairview Road and Arlington Road in the City of Costa
Mesa, County of Orange, State of California.
It is understood and agreed that this settlement is a compromise of a doubtful and
disputed claim,and the payment made is not to be construed as an admission of liability
on the part of Cedro Construction Inc. or the Costa Mesa Sanitary District, its officers,
agents, or employees, and that sa'd parties deny liability therefore and intend merely to
avoid litigation and buy their peace.
It Is further understood,intended and agreed that this Release shall be effective as
against all rights and benefits conferred upon Releasor(s)under Section 1542 of the Civil
Code of California which provides:
A General Release does not extend to claims which the creditor does not know
or suspect to exist in his favor at the time of executing the Release,which if
known by him must have materially effected a settlement with the debtor;
and any similar law of any state or territory of the United States,
Releasor hereby expressly waives any and all rights and benefits conferred under
the provisions of Section 1542 of the California Civil Code and any similar law of any
state or territory of the United States and hereby assumes full responsibility for any
injuries, damages, or images that he may incur from the above-mentioned event. Releasor
understands and acknowledges the significance and consequence of such specific waiver.
The Releasor hereby declares and represents that the injuries and damages
sustained are or may be permanent and progressive and that recovery and repair
therefrom is uncertain and indefinite and in making this Release it is understood and
agreed that the Releasor relies wholly upon the Releasor's judgment, belief and
knowledge of the nature, extent,effect,and duration of said injuries and liabilities
therefor and is made without reliance upon any statement or representation of the Cedro
Construction Inc. and Costa Mesa Sanitary District, its officers, agents, or employees or

by any physician or surgeon by them employed. The Releasor further declares and
represents that this Release is freely and voluntarily executed:that no promise,
inducement or agreement not herein expressed has been made to the Relessor, and that
Release contains the entire agreement between the parties hereto, and that the terms of
this Release are contractual and not a mere recital
It is hereby expressly agreed that in the event it shall become necessary to bring
suit in connection with any provision of this Release,the prevailing party shall be paid
such sum as the Court may adjudge as reasonable attorney's fees.
I hereby represent that at the time I signed this release I was not hospitalized or in
a medical facility nor was I admitted to a medical facility within the past fifteen days. I
further hereby represent that I have reads the forgoing release and frilly understand it.
