Contract- South Coast - 1984-03-08 AGREEMENT
THIS AGREEMENT entered into this 8th day of March 1984 by and
between the CITY OF COSTA MESA CALIFORNIA hereinafter called "CITY" and the COSTA
MESA SANITARY DISTRICT hereinafter called "DISTRICT'
WHEREAS at this time CITY is considering the initiation of proceedings pursuant to
the provisions of the 'Municipal Improvement Act of 1913' being Division 12 of the
Streets and Highways Code of the State of California for the construction of certain
public improvements together with appurtenances and appurtenant work to serve arid
benefit an area known and designated as
ASSESSMENT DISTRICT NO 82-2
(SOUTH COAST METRO CENTER)
hereinafter referred to as the "ASSESSMENT DISTRICT' and
WHEREAS, the sewer improvements upon their construction will be owned managed and
controlled by the DISTRICT rather than CITY and
WHEREAS pursuant to the provisions of Section 10110 of the Streets and Highways Code
of the State of California CITY and DISTRICT are desirous of setting forth the
terms conditions and responsibilities relating to the works of improvement as pro-
posed for the above-referenced ASSESSMENT DISTRICT
NOW THEREFORE IT IS MUTUALLY AGREED BETWEEN THE PARTIES AS FOLLOWS
SECTION 1 That the above recitals are all true and correct
SECTION 2 That the CITY will conduct proceedings and levy assessments pursuant to
the provisions of the 'Municipal Improvement Act of 1913' , being Division
12 of the Streets and Highways Code of the State of California and sell
bonds pursuant to the provisions of the Improvement Bond Act of 1915
being Division 10 of said Code for the construction of the above refe•
renced improvements which upon their completion will be owned managed
and controlled by DISTRICT
SECTION 3 That CITY shall call for bids and let a contract for the works of
improvement and CITY shall make all payments as necessary to pay the
costs and expenses for the installation and construction of the works of
improvement
SECTION 4 This Agreement shall become effective upon the completion of proceedings
and funds being available in order to carry out the construction of the
works of improvement
SECTION 5 Upon the completion of the works of improvement said improvements shall
become the property of and be owned managed and controlled by DISTRICT
