3 1970 by and between the COSTA MESA SANITARY DISTRICT a district
4 formed and existing under and by virtue of the Sanitary District
5 Act of 1923 hereinafter called DISTRICT and RING BROS a
6 California corporation hereinafter called BUILDER
7. W I T N E S S E T H T H A T
8 WHEREAS BUILDER has submitted to DISTRICT plans entitled
9 Improvements for Sewer and Water Main for Fair-Harbor Apts in
10 the City of Costa Mesa consisting of four (4) sheets and
11 WHEREAS BUILDER has requested approval of said plans by
12 DISTRICT inasmuch as said system will connect with facilities
13 owned and operated by DISTRICT and
14 WHEREAS the parties hereto desire to set forth their rights
15 liabilities and obligations hereunder
16 NOW THEREFORE for and in consideration of the covenants
17 herein contained performed and to be performed the parties
18 hereto agree as follows

20 It is understood and agreed by and between the parties hereto
21 that the estimated construction costs for the improvements herein
22 are $35 700 00 and that bond principal amounts will be calculated
23 upon this figure

25 BUILDER agrees to furnish DISTRICT with a good and sufficient
26 bond executed by a corporation authorized to transact surety
27 business in the State of California in the sum of $17 850 00 said
28 bond to be approved by DISTRICT or in lieu of said surety bond
29 to deposit with said DISTRICT a cash deposit in the amount of
30 $17 850 00 to secure the faithful performance of this agreement
31 In lieu of the above requirements BUILDER may furnish to DISTRICT
32 an instrument of credit in the amount of $35 700 00 being a sum

1 not in excess of the estimated costs of improvement

3 In addition to the faithful performance bond cash deposit
4 or instrument of credit as herein set forth BUILDER will furnish
5 to DISTRICT a separate bond cash deposit or instrument of credit
6 in the amount of $17 850 00 to secure the payment to the con-
7 tractor their subcontractors engineers surveyors equipment
8 rental established or any other persons or entities furnishing
9 labor or materials for the improvements subject of this agreement
10 IV
11 It is mutually agreed by and between the parties hereto
12 that the work to be done by BUILDER shall on the written
13 request of BUILDER made to the DISTRICT ENGINEER, be inspected
14 by him and if found to be in order approved during the course of
15 construction and in various stages of said construction
16 V
17 BUILDER may from time to time apply to the governing body
18 of the DISTRICT for exoneration of all or any part of said bonds
19 but in no event shall BUILDER be entitled to completely exonerate
20 said bonds until such time as the work herein has been completed
21 and the lien periods applicable have tolled
22 VI
23 BUILDER agrees to commence the construction and installation
24 of said improvement within 10 days after the approval of the
25 aforementioned plans and specifications and to complete the same
26 within .145- days from the date of commencement of work
27 VII
28 This agreement shall be binding upnn the successors in
29 interest of either of the parties hereto
