3 THIS AGREEMENT made and entered into this 15th day of
4 June 1971 by and between the COSTA MESA SANITARY
5 DISTRICT hereinafter called SANITARY DISTRICT and the NEWPORT
6 MESA UNIFIED SCHOOL DISTRICT hereinafter called SCHOOL DISTRICT
7 W I T N E S S E T H T H A T
8 WHEREAS SCHOOL DISTRICT has constructed certain sanitary
9 sewer lines on Baker Street between Century and Milbro Streets
10 in connection with the construction of SCHOOL DISTRICT s bus
11 transportation facility and
12 WHEREAS said sanitary sewer lines will also service other
13 properties at the time of their development and
14 WHEREAS it is deemed fair and equitable that adjacent and
15 abutting properties to said sewer facilities share in the cost
16 of construction of the same and
17 WHEREAS the parties hereto desire to set forth their rights
18 and liabilities in connection with the sharing of said construc-
19 tion costs
20 NOW THEREFORE for and in consideration of the covenants
21 herein contained performed and to be performed, the parties
22 hereto agree as follows

24 SCHOOL DISTRICT by this agreement relinquishes and dedi-
25 cates the entire sewer facility construction on Baker Street in
26 connection with the development of SCHOOL DISTRICT s bus transpor-
27 tation facility

29 SANITARY DISTRICT accepts said dedication and assumes the
30 responsibility of maintenance operation upkeep and repair of
31 said facilities

2 SANITARY DISTRICT agrees to refuse hook up or tie in to
3 said sewer lines by those parcels of real estate numbered
4 1 through 7 in a map attached hereto makred Exhibit A and by
5 this specific reference made a part hereof unless and until the
6 following payments are made

16 SANITARY DISTRICT AND SCHOOL DISTRICT hereby acknowledge
17 that Parcels 1 and 2 are the parcels on which there has been
18 constructed SCHOOL DISTRICT s bus transportation facility and
19 that the payment in the amount of $4 479 84 need not be made to
20 the SANITARY DISTRICT inasmuch as the entire line has been dedi-
21 cated to the SANITARY DISTRICT

23 SANITARY DISTRICT hereby reserves the right to assess a
24 charge of three per cent (3%) against each amount paid by any
25 subsequent developer said three per cent (3%) to cover the costs
26 and expenses of administering this contract on behalf of SCHOOL
27 DISTRICT Funds provided for herein will be collected prior to
28 the date the permit is granted to tie into the line subject to
29 this agreement and the same less three per cent (3%) administra-
30 tion costs will be remitted to SCHOOL DISTRICT after voucher
31 approval after the regular meeting of the SANITARY DISTRICT Board
32 of Directors after receipt of said funds
