Contract - Newport - 1971-09-01 1 A G R E E M E N T 2 3 A THIS AGREEMENT made and entered into this 1st day of SeD t!etuber 4 �tH�Y7�'X, 1971 by and between the COSTA MESA SANITARY DISTRICT OF 5 ORANGE COUNTY CALIFORNIA hereinafter referred to as DISTRICT 6 and the CITY OF NEWPORT BEACH a municipal corporation herein- 7 after called NEWPORT BEACH 8 W I T N E S S E T H T H A T 9 WHEREAS the Harbor Christian Church proposes to construct 10 a church facilities in the general location of the intersection 11 of Santa Isabel Avenue and Irvine Avenue in the City of Newport 12 Beach and 13 WHEREAS said church location is outside of the COSTA 14 MESA SANITARY DISTRICT and is not the intention of said DISTRICT 15 to annex said territory and 16 WHEREAS the City of Newport Beach desires to provide 17 sanitary sewer services to said church through the facilities 18 of the COSTA MESA SANITARY DISTRICT and 19 WHEREAS the parties hereto desire to set forth their 20 respect liabilities in connection with said services 21 NOW THEREFORE for and in consideration of the covenants 22 herein contained performed and to be performed the parties hereto 23 agree as follows 24 I 25 DISTRICT hereby agrees to authorize a connection to its 26 facilities in the general vicinity of Santa Isabel Avenue and 27 Irvine Avenue by Harbor Christian Church in accordance with 28 terms and conditions as shall hereinafter appear 29 II 30 Said sewer connection shall be made under the direction 31 of DISTRICT Engineer and shall comply with standard specifications 32 of the DISTRICT 1 III 2 The terms of this contract shall be for five (5) years 3 and the service charges to be imposed shall be calculated at a 4 base charge of $20 00 per annum with a five (5) percent per year 5 increase compounded with the actual amount to be paid in advance 6 prior to any connection to DISTRICT facilities 7 IV 8 Maintenance of the lateral from the church facilities to 9 DISTRICT S mains shall be by persons or entities other than 10 DISTRICT and in accordance with Ordinance #S of the DISTRICT 11 V 12 Sewer connection charges shall be paid in accordance with 13 rates established by DISTRICT Ordinance #6 and shall be payable 14 prior to the issuance of the permit by DISTRICT authorizing said 15 connection 16 VI 17 All construction of laterals which will connect with 18 DISTRICT facilities shall be done in accordance with DISTRICT 19 Standard Specifications and DISTRICT Engineer shall have the 20 obligation to inspect said construction at its various stages 21 and his decision with respect to standard specifications of the 22 DISTRICT shall be final 23 VII 24 This agreement shall be binding upon the sucessors :in 25 interest of the parties hereto 26 DATED on the day and year first above written 27 /// 28 /7/ 29 /// 30 /// 31 /7/ 32 /7/ - 2 - • 1 CITY OF NEWPORT BEACH COSTA MESA SANITARY DISTRICT e3 By !
