A G R E E M EN T
THIS AGREEMENT, executed this / Jd`' day of 6r3 , 1958,
by and between A. A. McCRAY, TRUS'T'EE, hereinafter referred to as 'TRUSTEE' ,
and the COSTA MESA SANITARY DISTRICT, hereinafter referred to as 'DISTRICT' ,
W I T N E S S E T H
WHEREAS, TRUSTEE has installed at his own expense, and is the owner
of certain eight inch (8" ) sewer mains and manholes situated on Dale Way and
College Street; and
WHEREAS, said TRUSTEE offers to grant said sewer mains and manholes
above described to said DISTRICT without cost to said DISTRICT on the condi-
tions hereinafter set forth, and
WHEREAS, it is to the advantage and best interests of said DISTRICT
to accept and maintain said sewer mains and manholes,
NOW, THEREFORE, it is mutually agreed between the parties hereto as
follows
1 A. A. McCray, Trustee, .does hereby agree to grant, assign and
transfer to the Costa Mesa Sanitary District the hereinafter described sewer
mains and manholes owned by said A. A. McCray, Trustee, upon the occurrance
of the first of the following:
(a) The payment to A. A. McCray, -Trustee, of the sum of Two
Thousand Seven Hundred Sixty-three Dollars ($2763 00), or
(b) The lapse of five (5) years from June 1, 1958
2. Prior to the occurrence of either (a) or (b) above, to-wit, the
payment to A. A. McCray, Trustee, of said sum of Two Thousand Seven Hundred
Sixty-three Dollars ($2763 00), or the lapse of five (5) years from June 1,
1958, the Costa Mesa Sanitary District is hereby granted the right to use
said sewer mains and manholes, provided that said DISTRICT shall not have
the right to allow any person to make connections thereto without the consent
of A. A. McCray, Trustee It is the intention of the parties to this Agree----
ment that the said payment above provided for in Paragraph 1 hereof shall
be made, not by the COSTA MESA SANITARY DISTRICT, but by any person or persons
who connect into said sewer mains

3 The sewer mains and manholes above referred to are described as
follows
Eight inch (8' ) Sewer Mains and manholes adjacent to the following
properties
Lots 1-4 Inclusive, Block 1, 205 Feet $461 25
Cummings and Moon addition to
Fairview Tract (Hollingworth)
Lot 36 and part of Lot 35 893 Feet $2009 25
Fairview Tract (Phillips)
A portion of Lot 28 of the 130 Feet $292 50
Fairview Tract (Killion)
