THIS AGREEMENT made .and entered into this al day of
r1944, by and between Frank T Johnson and C E
Stites, hereinafter referred to as the parties of the first
part, and COSTA MESA SANITARY DISTRICT, hereinafter, referred
,
to as the party ofrthe second part,
I T N E S S E T H H
WHEREAS, the party of the second part owns the following
described property in the County of Orange, State of California
That portion of Lot 1101 of Newport Mesa
Tract, as per map thereof recorded. in Book
5, at page 1, of Miscellaneous Maps, records
of said Orange County, California, described
as follows Beginning at a point in the cen-
ter line of 19th Street, distant thereon 345
feet Easterly from the center line of Whittier
Avenue as said streets are shown on said map,
and running thence Southerly parallel with
said center line of Whittier Avenue, 330 feet
to the South line of said Lot 1101; thence
Easterly along said South line 315 feet to
the Southeast forner of said Lot; ,thence
Northerly along said East line, and the
e2tension thereof, 330 feet to the center line
of 19th Street; thence Westerly along said
center line 316 feet to the point of beginning;
and the parties of the first part own the following described
property in the County of Orange, State of California
Lot 1001 of Newport Mesa Tract, as per map
thereof recorded in_ Book 5, at page 1, of
Miscellaneous Maps, records of said Orange
County, California;
AND WHEREAS, the party of the second part desires to lay and
install a two inch water pipe line from a point on the East
line of said lot 1001, 150 feet North of the Southeast corner
thereof inra Westerly, direction .along the center line of said
lot to a point on the West line of said lot, Which is 150 feet
North of the :Southwest corner of said lot, which pipe line is
, to supply water to the East half of Lot 1101 first above des-
cribed belonging to the party of the second part;

NOW, THEREFORE, .in consideration of the mutual covenants
herein contained,
The parties of the first part do hereby give, -grant and con-
vey to the party of the second part, the right to lay a two inch
water pipe .from a point .on the east line of said lot 1001, which
point is. 150. feet North of the southeast -corner of said lot, said
pipe line to run in a westerly direction along the center line of
said lot to a point on the West line of said lot which is 150 feet
North of the Southwest corner of said lot , including the right to
the second party to enter upon the property of the first parties
to the extent necessary to install and lay said pipe line and to
maintain the same, and as a part of the consideration hereof, party
of the second part agrees to immediately lay said pipe line as here-
in provided
It is understood and agreed between the parties hereto that
said two inch water line is to be laid and placed at least eighteen
inches below the present ground level of the above described proper-
ty of first parties, and that second party is. te 'install for the use
of. the first parties, risers or outlets along said pipe line at points
designated by the parties of the first. part, which risers or outlets
shall .not •exceed in number
It is further understood andc.agreed between the parties hereto
that the cost of said pipe line shall be :born -one-half by parties of
the first part, •and one-half by party of the second part
The above described pipe line is to remain permanently upon
said above described Lot 1001, and shall 'be maintained in. good con-
dition by the owners of the above described East half of Lot 1101,
in consideration for which the above described portion of .Lot 1101
is to be serviced with water through the above-described pipe lines
