A G R E E M E N T
THIS AGREEMENT made• and entered into this 9th day of October
1944 by and between Oscar Flensberg
hereinafter referred to• as the party of the first part , and Costa
Mesa Sanitary District hereinafter referred to. as the party of the
second part
W I T N E S S E T H
WHEREAS the party of the second part owns the following de-
scribed property in the County of Orange- State of California.
That portion of Lot 1101 of Newport Meea Tract
as per map thereof recorded in Book 5 at page
1 of Miscellaneous Maps records of said Orange
County, California described as followe Begin-
ning at a point in the center line of 19th Street
distant thereon 345- feet Easterly from- the center
line of Whittier Avenue as said street's are shown
on said nap and running thence Southerly parallel
with said center line of Whittier Avenue 330 feet
to the South line of said Lot 1101, thence Easter-
ly along said South line 315 .feet to the South-
east corner of said Lot, thence Northerly along
said East. line and the extension thereof. 330
feet to the center line of 19th Street, thence
Westerly along said center line 315 feet to the
point of beginning,
and the party of the first part owns the following described proper-
ty in the County of Orange, State of California
Lot 1102 of Newport Mesa Tract as per map thereof
recorded in Book 5 at page 1 , of hiscellaneous
Maps , records of said Orange County California
AND WHEREAS., the party of the second part desires to lay and
install a two inch water pipe line from the line of the Newport Mesa
Irrigation District lying in Whittier Street West of said Lot 1102
to the property of party of second part above described
NOW THEREFORE in consideration of the mutual covenants herein
contained
The party of the first part does hereby give, grant and convey
to the party of the second part the right to lay a two inch water pipe
line from Whittier 'Street East a distance of approximately 320 feet
along the North 2 feet. of the property owned by first party above

described to the Southwest corner of the above described property
owned. by second party, including the right to the second party to
enter upon the property of the first party to the extent necessary
to install and lay said pipeline and to maintain the same and as
part of the consideration of said land, party of the second part
agrees to immediately lay said pipe line as herein provided
It' is understood and agreed between the parties hereto that
said two inch water pipe line is to be laid and placed at least
eighteen inches below the present ground level of the above described
property of first party, and that second party is to install for the
use of the first party two two-inch stand pipes or risers one of
which is to be at a point designated by the party of the first part
approximately midway between the point where said line enters the
property of the second party and the East line of Whittier Street
and the other one is to be near the East end of the line before it
enters the property of the party of the second part, and hear the
point of connection of said pipe line with the above described proper-
ty of second party
The above described pipe line is to remain permanently upon
said above described Lot 1102 and shall be maintained in good con-
ditionby the owners of the above described East half of Lot 1101
in Consideration for which the above described portion of Lot 1101
is to be serviced with water through the above described pipe line
IN WITNESS WHEREOF the parties hereto have executed within in-
strument the day and year first hereinabove written.
