A G R E E M E N T
THIS AGREEMENT, executed this 4th day of September , 1958,
by and between DIKE & COT,FGROVE, INC , a California corporation, hereinafter
referred to as 'COMPANY' , and the COSTA MESA SANITARY DISTRICT, hereinafter re-
ferred to as 'DISTRICT' ,
W I T N E S S E T H
WHEREAS, COMPANY has installed at its om expense, and is the owner of
sixty-two (62) lineal feet of eight-inch (8' ) sewer main and one (1) drop manhole
situated in the vicinity of the intersection of Fairview Road and Fair Drive,
adjacent to the boundaries of Tentative Tract No 2029 in the City of Costa Mesa,
and
[AREAS, said COMPANY offers to grant said sewer main and drop manhole
above described to said DISTRICT without cost to said DISTRICT on the conditions
hereinafter set forth, and
me AS, it is to the advantage and best interests of said DISTRICT to
accept said sewer main and drop manhole,
NOW, THEREFORE, it is mutually agreed between the parties hereto as
follows
1 Dike & Colegrove, Inc , does hereby agree to grant, assign and
transfer to the Costa Mesa Sanitary District the hereinafter described sewermain
and drop manhole owned by said Dike & Colegrove, Inc , upon the occurrance of
the first of the following:
(a) The payment to Dike & Colegrove, Inc , of the sum of
Five Hundred Forty Dollars ($540 00), or
(b) The lapse of five (5) years from the date of this Agreement
2 Prior to the occurrence of either (a) or (b) above, to-wit, the pay-
ment to Dike and Colegrove, Inc , of said sum of Five Hundred Forty Dollars
($540 00), or the lapse of five (5) years, the Costa Mesa Sanitary District is
hereby granted the right to use said sewer main and drop manhole, provided that
said DISTRICT shall not have the right to allow any person to make connections
thereto without the consent of Dike & Colegrove, Inc It is the intention of the
parties to this Agreement that the said payment above provided for in Paragraph 1
hereof shall be made, not by the COSTA MESA SANITARY DISTRICT, but by any person
or persons who connect into said sewer main.

3 The sewer main and drop manhole above referred to are described
as follows
'Sixty-Two (62) lineal feet of eight-inch (8' ) sewer main
and one (1) drop manhole, situated in the vicinity of the
intersection of Fairview Road and Fair Drive, adjacent to the
boundaries of Tentative Tract No 2029 in the City of Costa
Mesa. "
