Contract - Curbside - 2006-08-14 ADDENDUM NO. -1
This Addendum to Agreement is made and effective as of 149' day of August,
2006, between the Costa Mesa Sanitary District, a sanitary district ('District") and
Curbside, Inc, (a California corporation) ("Contractor").
RECITALS
WHEREAS the District and Contractor have entered into an agreement dated
October 12, 2005 which provides for Contractor to perform the tasks described and set
forth in the Door-to-Door Household Hazardous Waste (HHW) Operational Plan,
Exhibit A to the Agreement; and
WHEREAS, the District is committed to educating District trash customers and
preventing HHW from entering the waste stream; and
WHEREAS, the District intends to implement a pilot Stormwater Compliance
Program — Small Battery Recycling Program Focus — including collection services as a
pilot program with potential District-wide implementation; and
WHEREAS since February 9 2006 it is no longer legal to dispose of HHW
household batteries in the trash or California landfills; and
WHEREAS, the Small Battery Recycling Program will provide the District's
21,300 residential trash collection customers with education and more readily available
means to properly dispose of household batteries; and
WHEREAS the District recognizes Contractor is the only capable Southern
California provider for Door-to-Door HHW collection services including batteries and
electronics, in addition to managing electronics collection events:
NOW THEREFORE, the parties hereto agree as follows:
1 Contractor shall provide household battery collection services from up to 10
District sites initially selected by the District. Contractor will make any necessary
agreements with the District selected collection sites. Proposed sites include the
District Headquarters building, District high schools, selected City of Costa Mesa
Fire stations libraries and senior centers;
2. District shall select and modify the collection sites depending on program
success and available funding.
3. Contractor shall provide leak-proof five and one-half gallon containers capable of
holding 80-100 pounds and have a hole in the top for depositing batteries. The
container shall be labeled indicating it is only for small batteries.
4 Contractor shall collect the following batteries from the selected sites:
a. NiCad - rechargeable,
b. Alkaline/Zinc/Carbon -one time use:
c. Nickel Zinc- one time use;
d. Silver Oxide - one time use (hearing aid, etc);
e. Nickel Metal Hydride -rechargeable (used in cell phones);
f. Lithium Ion -- rechargeable (used in computers, cell phones);
g. Mercury batteries-- one time use (hearing aid, watches);
5. When the container is full, the sponsoring site representative or District will
contact Contractor for collection and Contractor will replace the container with an
empty container at the site.
6. District will pay Contractor $175.00 per collected bucket to include full payment
for recycling of batteries, collection and transportation of batteries and the cost of
the bucket and insurance. Contractor is responsible for any required permitting.
District will pay a $50 00 deposit for each bucket site used. Contractor will invoice
District $175.00 each time a bucket is collected. Should the program terminate
the deposit will be credited against the last invoice
7 Curbside will bag and remove other HHW materials when encountered, but it is
the intent for the site monitors to limit the drop-off of materials other than
batteries.
IN WITNESS WHEREOF the parties hereto have caused this Agreement Addendum to
be executed the day and year first above written.
