THIS AGREEMENT made and entered into this ,_`T day of

a Municipal Corporation, hereinafter called 'CITY' , and the

COSTA MESA SANITARY DISTRICT OF ORANGE COUNTY, California,

hereinafter called "DISTRICT", and the COSTA MESA MUNICIPAL
7 GOLF AND COUNTRY CLUB, INC , hereafter called "'COUNTRY CLUB"-
WITNESSETH THAT

WHEREAS, City has negotiated and agreed t.ith. 0 J Seger-

strom & Sons for certain improvements to be- made on Golf Course

11 Drive and Mesa Verde Drive East in exchange for dedication -of
right of way .by said Segerstiomsi. and

13 WHEREAS said improvement includes installation of sanitary
14 sewers along both streets: and
15 WHEREAS, the District desires to install said lines .and to
16 serve the properties belonging to said Country Club, and
17 WHEREAS the' parties hereto desire to- set forth their
18 various interests, obligations and responsibilities
19 NOW, THEREFORE, for and in consideration of the covenants
20 herein' contained performed and to be performed the parties
21' hereto agree as follows:

23 Sanitary District agrees to install sanitary- -sewer lines
24., ' along the--full length of Mesa Verde Drive East connecting said
25 lines to existing facilities at each -end of said street
26 District also agrees to- install sanitary lines from a •point on
27 Mesa Verde :DrivejEast connecting with the heretofore described
28 facilities' to the property line• running ih a general Last-West
29 direction between, the property of C J Segerstrom & Sans' and

30 that of the• State of California now under lease to the Country
31 Club for development of the thirty-six hole golf course

2• ,• Sanitary District agrees to accept connection ,with. a line
to be constructed by Country Club from the' aforesaid boundary
4 to the clubhouse 'and" to serve clubhouse ,with, its sanitary :sewer ,
5 system for the Sum of $100 00 per year payable in advance on- the
6 'day that said .line is put into operation. The District shall
7 invoice e Country Club annually at the anniversary date of
s. : this agreement. and -said 'payment of 1100 '00 'shall be-due, owing

13: ' liable ,for any of, the frontage charge payable at the time of
14 hook-up to .the main .sanitary Sewer line in• Mesa "Verde Drive
15 East and}.:Golf Course Drive Sanitary District does: hot waive

17; ; between, :all parties hereto that the same Shall 'be' paid to the
'1s sanitary 'distridt at the time of ;any hook-up to the main

23' shall be borne one -half (1/2) by the school facility' to be

25 Construction "shall actually be provided for. by Sanitary District
26 and. Sanitary District agrees to procure payment of, one-half (1-2)
