Contract - Bulot, Francis H. - 1951-01-04 A G R E E M E N T THIS AGREEMENT made and entered into this `y' day of t/a nu a r ' , 1951, by and between the COSTA MESA SANITARY DISTRICT of Orange County, California, hereinafter referred to as the.party of the First Part, and FRANCIS H. BULOT, doing business as FRANCIS H. BULOT, CONSULTING ENGINEERS, of 411 West Fifth Street, Los Angeles, California, party of the Second Part, W I T N E S S E T H: WHEREAS, it is contemplated and is the intention of the Board of the Costa Mesa Sanitary District to carry through proceedings for the con- struction of a sanitary sewage collection system for the areas within the District, and WHEREAS, it is required that a registered Civil Engineer be engaged to perform the engineering services necessary for the supervision of construction of such work, NOW, THEREFORE, the party of the First Part does hereby agree to engage the party of the Second Part to perform engineering services relating to the supervision of construction as follows: 1. Provide all necessary personnel for inspection of materials and items of construction. 2. Set all line, grade and location stakes for the • sewer construction and appurtenances. 3. Prepare complete "as built" construction draw- ings, as the work progresses, showing actual locations and profiles of the sewers. 4. Make all inspections of materials and all work done in accordance with the construction contract and specifications. 5. Prepare partial monthly estimates of work com- pleted by the contractor and make certification of same to the District. • - 2 - 47-4"-GC/ Ai f paynven 71-- Jcco,,d r 6. Prepare final estimate and certificate of final payment to the contractor in accordance with the construction contract. 7. Perform all other engineering services as stip- ulated in the Contract Documents and Specifica- tions. 8. Assist the District in evaluating contractors' bids and in making an award of the construction contract. 9. Prepare and furnish set of original, complete, detailed plans and specifications incorporating the area in the original Sanitary District and the annexed areas, suitable for the calling for bids and an award of a construction contract. It is understood and agreed that the party of the First Part will pay and the party of the Second Part will receive for the performance of the above set forth supervision of construction a sum equal to 3.15 per cent of the actual cost of construction, said sum to be paid to the party of the Second Part at the rate of Two Thousand Dollars (2,000.00) per month for a period of twelve (12) months, the first payment becoming due upon the award of a construction contract; it being further agreed and un- derstood that the twelfth or final payment shall be adjusted in such an amount that the total payment for supervision shall be 3.15 per cent of the actual cost of construction. It is further understood and agreed that all references to supervision of construction as set forth in two existing contracts, dated November 7, 1946, and April 19, 1950, respectively', are hereby superseded by this Agreement. It is understood and agreed that the party of the Second Part is to commence work upon the advertising for bids for the construction of the sewer system. IN WITNESS WHEREOF, FRANCIS H.
