The District is also responsible for liquid waste collection and transmission to County facilities for treatment and disposal. The District developed and administers numerous recycling programs for the City of Costa Mesa, Santa Ana Heights and other portions of unincorporated Orange County. The primary objective of the Costa Mesa Sanitary District project "Choose to Recycle" was to provide a convenient mechanism for the collection of beverage containers at public facilities and venues. The project enabled the District to purchase beverage container - recycling receptacles to encourage recycling of beverage containers. Initially, a total of twenty -six receptacles were purchased for placement at sixteen locations. Seven concrete receptacles were placed at TeWinkle Park, Goathill Junction, the home of a model railroad, and Costa Mesa High School. Nineteen containers were placed at City fire stations, police facilities and on each floor of Costa Mesa City Hall. Recycling captains were selected for each receptacle location with an incentive of a picnic bench, made of recycled material, for providing accurate and timely monthly reports. An additional fifteen indoor receptacles were purchased -for use at the City Hall location. Grant Award and Use of Funds The District was awarded $18,350 in grant funding for the purchase of beverage container receptacles for the grant period November 2, 1998 through June 30, 2000. Initially, nineteen Rubbermaid 23- gallon Slim Jim recycling receptacles were purchased for the indoor locations. An additional fifteen receptacles were purchased to augment the receptacles at City Hall. Engraved plates with Department of Conservation logo were purchased for all of the indoor containers as well as liners. Seven Quikcrete concrete containers with liners and recycling logo inset were purchased for the outdoor locations. Locks were also purchased for the concrete containers. A hexagon picnic bench /table was purchased from US Plastics Lumber. 2 Project Successes The project was successful at City Hall with a heightened awareness of the benefits of recycling beverage containers, justifying the purchase of additional receptacles for this facility. The fire station personnel were already avid beverage container recyclers, and the program further promoted recycling. Problems /Concerns Initial difficulties encountered in the program included choosing containers for the outside locations; approval by City staff was required and many obstacles had to be overcome. The original date for the major kick -off event for the program had to be postponed due to a new sewer main being installed at the Goathill Junction location. Promotion of the Beverage Container Grant Program occurred at the Goathill Junction location on July 17, 1999 at the dedication of restroom facilities and a snack bar. Members of the Board of Directors were present along with District staff and promotional and recycling products were distributed. Obtaining collection data from the Recycling Captains on a timely basis was a challenge and proved to be an ongoing problem. Phone calls and E -mails were made to each individual reminding them to report their data; staff visited the sites and communicated with employee associations to encourage timely data reporting. The outdoor containers located at Costa Mesa High School and TeWinkle Park have not worked well for collection of beverage containers, apparently due to lack of interest by the students. At these sites, trash accumulated in the containers with few beverage containers. To elicit greater participation at the High School, the school representative was contacted and encouraged to initiate announcements over the public address system reminding students of the beverage container recycling program. Unfortunately, there was not significant usage of the receptacles. Findings and Conclusions The two beverage recycling containers located at Costa Mesa High School were not properly utilized or monitored by the school organization responsible for them. The lids were broken and trash accumulated in the containers. Several attempts were made to prevent trash and debris from being thrown into the containers but were unsuccessful. Eventually, the school requested removal of the containers from the premises. The City of Costa Mesa recently completed construction of a Soccer Complex with six fields and a snack bar. The beverage 3 recycling containers have been relocated to the Soccer Complex. With approval of the Grant Manager, replacement lids for these two receptacles have been ordered due to the poor condition of the existing lids. The visitors to the soccer complex are more likely to have beverage containers rather than food and other trash. Collection of beverage containers at the Soccer Complex should prove more successful. Future Intent to Support /Maintain Project Beverage containers will continue to be collected at all locations; the Conservation Corps of Orange County has agreed to collect the containers from the receptacles at the TeWinkle Park location. The city's Sanitary District, which received $18,350, was one of 27 agencies that split more than 51.3 million in grant money to help promote recycling. Altogeth- er, 79 agencies applied for more than $6 million in funds. "This is going to be a great program for the city," said Jim Ferryman, board president. "We feel fortunate that we were picked. It is fulfilling a real need and it will help us get to the 50% landfill diversion goaL " Cities must divert 50 0,'0 of their trash from landfills by 2000 to meet state mandates. Trash is now sent to a facility in Stanton that mechanically sorts it for recy- clables. The district offers special recycling programs throughout the year for telephone books and Christmas trees, but these will be the first permanent recycling con- tainers the district has had, Ferry- man said. More than 20 containers will be placed around the city in pub- lic areas such as City Hall and J Fairview Park, said Joan Revak of the Sanitary District. Box 1200 Costa Mesa, CA 92626 Dear Tom, Safety- Kleen filed for Chapter I 1 protection last month. This is a direct result of the hostile takeover by Laidlaw Environmental Services of Safety- Kleen Corp. The price paid for Safety - Kleen was higher than Laidlaw (now Safety - Kleen) could afford to repay. When the balloon payments were due, the banks were notified and the banks told Safety - Kleen to file for protection. k The company is profitable now and was profitable when the merger took place. The judge granted Chapter 11 status because Safety- Kleen proved to the court that there were more than $1.2 billion dollars more in assets than was owed. As a result of the filing, a $100 million line of credit has been established. Since the line of credit was established, no funds have been drawn against it. Current cash flow is supporting the business. Safety - Kleen will emerge from Chapter 11 with less than $1 billion in debt and more than $2.2 billion in assets. The banks and perhaps others should receive equity for debt. The entire process has not affected this program or any other program that we manage. Because Curbside is not a wholly owned subsidiary, we are not affected by the filing. Waste is being managed properly; there have been no layoffs or facility closures as a result of this filing. The branches have continued to do business as usual. All liability insurance policies are in force and the company is building cash reserves again. If I can answer any questions please contact me. The hazardous waste disposal concern, which filed for bankruptcy along with 73 affiliates, estimates it has more than 1,00 creditors and that funds will be available for distribution to unsecured creditors. Bank of Nova Scotia Trust Co., indenture trustee for Safety - Kleen's 9.25% senior subordinated notes, is listed as the company's largest unsecured creditor with a $325 million claim plus interest. Board resolutions included in the filing authorize company officers to enter into a debtor-in- possession, or DIP, credit agreement. No turther details are provided. A source close to the case told Federal Filings Business News that GE Capital Corp., a unit of General Electric Co. (GE, news, msgs), would likely provide Safety -Kieen with DIP financing. s "First day" hearings, at which time Safety -Kleen will seek court authorization to pay pre - petition wages and salaries, ar scheduled for Tuesday. Safety -Kleen is represented by David S. Kurtz of Skadden Arps Slate Meagher & Flom in Chicago and by Gregg M. Gilal of Skadden Arps' in Wilmington. The lead case has been assigned number 00- 02303, but the name of the judge assigned to the case wasn't immediately available. Safety -Kleen spokesman John Kyte said the company is still working on its DIP financing and trying to finalize an agreement. He wouldn't comment further. Kyte said Safety -Kleen wasn't coordinating efforts in the case with Laidlaw Inc. (LDW, news, msgs), which owns 44% of Safety -Kleen and is itself widely expected to file for bankruptcy in the near future. Hurt by Safety - Kleen's troubles, Laidlaw was forced to acknowledge that its own financial statements from fiscal 1997 through the first quarter of fiscal 2000 may be unreliable because of Safety - Kleen's accounting irregularities. On March 7, Safety -Kleen put Chief Executive Kenneth W. Winger, Executive Vice President and Chief Operating Officei Michael J. Bragagnolo and Chief Financial Officer Paul R. Humphreys on administrative leave as the company began an . internal investigation of its accounting practices. A probe into the allegations revealed inappropriate recognition of gains on derivatives and revenue, as well as inappropriate capitalization of costs. In early May, the three executives resigned, with Chairman David E. Thomas and Vice Chairman Grover C. Wrenn being put in charge of day -to -day operations. On May 23, the company named Thomas chief executive and Wrenn president a. chief operating officer. As reported, Jay Alix & Associates is serving as Safety - Kleen's restructuring consultants. On March 21, Safety -Klee, Corp. named Jay Alix principal John G. McGregor interim chief financial officer and retained the Southfield, Mich. -base,- turnaround firm. Kyle said no new professional hires have yet been made. And he wouldn't comment on the motions Safety -Kleen planner to file at its first day hearing Tuesday. Laidlaw reported losses of $1.46 billion, or $4.48 a share, for its second quarter ended Feb. 29. Those results included write -downs of $1.39 billion for problems with its health -care unit and the Safety -Kleen investigation. Laidlaw said in mid -May that it wouldn't pursue extensions of a waiver on bank facility covenants past May 31, acknowledging that it wouldn't be in compliance with covenants after that time. Last Tuesday, Safety -Kleen said it didn't make certain interest and principal payments the preceding week and terminated the planned sale of its Elgin, III., facility for $21.5 million. Before the March investigation, Safety -Kleen reported operating earnings of $51 million, or 18 cents a share in fiscal 1998, and $103.9 million, or $1.03 a diluted share in fiscal 1999. The company hasn't yet issued restated figures. In a press release Friday, Safety -Kleen said the bankruptcy filing comes "with the support and cooperation" of senior secured lenders holding claims of more than $1.6 billion against the company. Safety -Kleen said customers and employees would be "largely unaffected" by the filing, which isn't expected to interrupt the company's normal operations.
