Directors Present: Dan Worthington, Jim Ferryman Staff Present: Rob Harriers, Tom Fauth, Joan Revak, Bobby Young Director Worthington called the meeting to order at 9:00 a. m. STRATEGIC PLANNING 2003 - PUBLIC OUTREACH - CLASSROOM RECYCLING PROJECTS Director Worthington reported presentations were made at the Carolyn Eckert Day Care Center on Wednesday, November 19 and at St. Joachim's School on Friday, • November 21. Presentations have been scheduled for January 8, 2004 to second and third grade students. COSTAMAZING — DISTRICT PARTICIPATION Ms. Revak informed the Committee that the sealed cards featuring the Adobe at Estancia Park pepper trees with the peppercorns are in production and will be distributed at the CostaMazing Fun Run on February 7, 2004. The card features a picture of the Adobe at the Costa Mesa Estancia at 1900 Adams Avenue with history on the Adobe and the peppercorns. 2003 SCHOOL TELEPHONE BOOK RECYCLING PROGRAM Ms. Revak reported the 2003 School Telephone Book Recycling Program began on December 1, 2003 and will run to January 12, 2004. Bins were distributed to the 27 participating schools The District's program challenges the students to collect the most telephone books and be rewarded in addition to providing a hands -on opportunity to learn about recycling. Trees will be collected beginning December 26, 2003. Newspaper reports indicate fresh tree sales have dropped in recent years and the sale of artificial trees has increased. RECYCLING BATTERIES Director Worthington and Mr. Fauth visited Toxco, Inc. to inquire about their battery recycling operation and presented a sample "big green box" container for the recycling of batteries. Director Worthington reported approximately 3 billion batteries are sold each year and forthcoming regulations will require the District to remove batteries from the waste stream. Mr. AI -Imam provided a synopsis of the procedure used to audit the District's Financial Statements and answered questions from the Board. Hensley, Chief of Police, City of Costa Mesa, thanking the District for the letter of appreciation sent to him by the Board. Mr. Hamers reported receiving a card from the 6th grade students and teachers of Davis Elementary thanking the District for the assembly presentation. Mr. Hamers reported receiving a letter from Israel Bravo, student at Davis Elementary, dated November 12, 2003. Israel thanked the District for the recycling program and inquired as to additional things he could do to promote recycling. Director Worthington replied to the letter .' and forwarded some newsletter copies for distribution. PUBLIC COMMENTS There were no public comments made. Verification of addresses. Distribution of telephone book recycling flyers. Mr. Shef provided a written report of a citation to a resident at 174 The Masters Circle. STANDARDIZED CONTAINER PROGRAM — LIFTING BAR REPLACEMENT UPDATE Mr. Harriers reported the program is winding down and will be moved to the Consent Calendar for future agendas. 19 - Mr. Fauth reported there are approximately 5,000 containers left to retrofit and projected the completion in approximately 10 months at the current rate of 500 per month. CMSD STRATEGIC PLAN — (REVISITED) . YEAR 2003/2004 ACTION ITEMS Mr. Hamers reported the title has been changed to reflect a 2 -year plan as directed by the Board. Mr. Puckett commended the hard work of the entire finance department and credited them with the outstanding review by the auditor. Discussion was held regarding an accounting software package. INSTITUTIONAL ISSUES LETTER FROM CITY MANAGER DATED NOVEMBER 26, 2003 Mr. Harriers presented a follow up letter from Mr. Allan Roeder, City Manager, City of Costa Mesa, dated November 26, 2003. Mr. Harriers suggested a special. meeting be scheduled to discuss the financial software package and the progress on locating a new facility for the District offices and to review the information provided by the City regarding the retention of the field crew and Mr. Puckett's services. A response to the City Manager will be prepared to concur that Mr. • Burns will prepare the first draft of the new City /District Agreement for review and consideration by both parties. The District anticipates receiving the financial information from the City by January 8, 2004. CONTRACT PAYMENT TO CR TRANSFER FOR RECYCLING SERVICES AND DISPOSAL PAYMENT FOR NOVEMBER 2003 SERVICES Director Woodside motioned to approve contract payment to CR Transfer for recycling services and disposal for the month of November 2003, in the amount of $149,078.91. Director Perry seconded. Motion carried 5 -0. RECYCLING COMMITTEE — WEDNESDAY, DECEMBER 9, 2003, 9:00 A.M., CR -5A, DIRECTORS WORTHINGTON AND FERRYMAN STRATEGIC PLANNING 2003 — PUBLIC OUTREACH — CLASSROOM RECYCLING PROJECTS Director Worthington reported a vermicomposting test program will be delivered on January 6, 2004 to two classes of second and third grade students. Two additional presentations will be provided if the initial test presentation is successful. Two vermicomposting presentations were successfully provided this month at Carolyn Eckert Daycare and St. Joachim's School. The District will be required to remove batteries from the trash. Staff will research the program and recommend an approach and provide cost information to the Board. ENGINEER'S REPORTS WASTE DISCHARGE REQUIREMENTS — (WDR) GENERAL UPDATE Mr. Hamers reported the steering committee is continuing their work and there is nothing significant to report. SANTA ANA RIVER FLOOD PROTECTION AGENCY MEETING ON NOVEMBER 13, 2003 Director Ferryman attended the November 13, 2003, meeting and reported the following: • Jim McConnell, Washington DC, reported funds would be made available to insure construction is not interrupted on the Santa Ana River Mainstem Project and the Prado Dam Project. • Subvention Funds INDEPENDENT SPECIAL DISTRICTS OF ORANGE COUNTY (ISDOC) • President Schafer attended the December 9, 2003, meeting and reported they discussed the following: • January 29, 2004 will be the next Quarterly meeting with Jim Silva as guest speaker. COSTA MESA SANITARY DISTRICT MINUTES OF BOARD OF DIRECTORS REGULAR MEETING DECEMBER 10, 2003 PAGE 11 CALIFORNIA SPECIAL DISTRICTS ASSOCIATION (CSDA) President Schafer attended the Annual Strategic Board meeting and reported the following: • Appointed to the following committees o Chair Nominations and Bylaws Committee o Legislative Committee o Membership Committee Vice Chair o Fiscal Committee • Voted on the purchase of a building with the Risk Management Organization. CSDA will occupy the first floor -, a 24,000 sq. ft. area LOCAL TAXPAYERS AND PUBLIC SAFETY PROTECTION ACT President Schafer reported CSDA has been asked to sit with the California League of Cities to discuss funding to get the Local Taxpayers and Public Safety Protection Act on the November 2004 ballot. • President Schafer investigated the legality of the financial contribution and was instructed that it is legal to supply start up money, but once the item is on the ballot, no further funding is allowed. Mr. Burns requested time to investigate the measure and provide a legal opinion. Staff will bring the item back at the January 2004 meeting. LOCAL GOVERNMENT BALLOT INITIATIVE Item will be brought back at the January 2004 regular meeting. 2004 MEMBERSHIP DUES IN THE AMOUNT OF $2,373.00 Director Woodside motioned to approve payment of Membership Dues to CSDA in the amount of $2,373.00. Director Ferryman seconded. Motion carried 5 -0. FOG Characterization Study The committee discussed the status of CMSD Project #172 — Waste Discharge Requirements; specifically the fats, oils, and grease (FOG) characterization study. The District's consultant EEC has visited 75 of the 400 food service establishments and distributed the notebooks and grease control information. The field crews, Paul, and Tom have met with EEC to plan the sewer line televising of the hot spots to determine whether grease or structural problems are the cause of the field crews having to constantly clean the lines. Hot spots that are caused by excessive grease will be correlated to the food service establishments connected to the lines that do not have grease control devices. These food service establishments will be required to implement grease control practices that limit their discharge of grease. The first phase of televising the hot spots will begin the week of December 22, 2003. II. Inflow Inflow is defined as the entry of surface water into the sewer system, usually through the vent holes in the manhole covers during a rain large enough to cause flooding of streets or by illegal connections where property owners solve their on -site ponding problems by connecting a drain to the sewer system. A study by the Orange County Sanitation District (OCSD) has determined that certain areas inside the Costa Mesa Sanitary District have large amounts of inflow. Gerry and Paul believe these are probably at the Cherry Lake in Newport Beach where the sewer manholes may be under water during a large rain. Gerry and Paul are awaiting the next rain storm to determine the cause of the inflow. Costa Mesa Sanitary District Minutes — Safety/Loss Control Committee Meeting held December 16, 2003 Another method of preventing inflow into manhole covers is to install a device inside • the manhole cover shaped like a pan that prevents the rain water from intruding. Gerry will order 10 inflow covers and install them as a test. III. Link -Pipe Paul reported that a few of the Link -Pipe stainless steel rings used to repair small problems in the sewer main lines years ago have become dislodged and were removed from the lines. Rob will contact National Plant Services, Inc., the District's televising contractor, to arrange for a new repair of cured -in- place -pipe (CIPP) at each of the locations. IV. CWEA Certification Tom is holding review classes for the field crews in order to prepare for the upcoming California Water Environment Association (CWEA) testing for sewer collection system workers. V. Permit Processing & Education • purpose Safety /Loss u ose of the Safet /Loss Control Committee is to prevent damage and losses from occurring that can be prevented by well conceived policies and procedures. Debbie continues to insure all contractors performing sewer work have the proper license and insurance on file prior to beginning work. Joan continues publishing newsletters, articles and flyers that inform property owners and residents of sewer and trash operations and how to properly perform their responsibilities in an efficient and effective manner. Only the Thanksgiving holiday caused the collection to be one day late for the balance of that week. Thirty courtesy flyers were left for residents with four containers oversprayed and i.d. due to painted graffiti. Christmas tree flyers were printed earlier this year although there are fewer tree lots this year. Distribution was made to the four lots this year with business licenses issued to only two since the other two were part of the fairgrounds and IKEA property. Only two Rite Aid stores and Target sold trees this year with the super markets electing not to sell any due to the • ongoing strike. All tree lots this year ordered less inventory so as to not get stuck with leftovers and all were sold out a week before Christmas. Fewer people this year are going with live trees. Flyers and posters were still delivered to all likely stores where residents could at least be informed of tree recycling program and how to dispose of their spent trees. LJ Staff requested the E.O. to check the telephone book recycling dumpsters placed at the District schools. By the last week of this period and after checking eight to ten schools, very few phone books had been turned in. Some bins had no books only trash placed in them by unaware residents. New phone books due out in November had not yet been delivered in December. Also some schools had the bins placed in locations which prompted trash to be placed in them. The new "Universal Waste Rule" regulations are in the California Code of Regulations, title 22, division 4.5 chapter 23. All universal wastes are hazardous wastes and, without the new rules, they would have to be managed under the same stringent standards as other hazardous wastes. Also, the universal wastes are generated by a wide variety of people rather than by the industrial businesses that primarily generate other hazardous wastes. An unwanted material may be considered hazardous if it has any of the following properties: Toxicity, Reactivity (explosive), Ignitability or Corrosivity (Acidic or alkaline). Universal wastes include: 1. Mercury Thermostats 2. Batteries 3. Lamps (fluorescent, high intensity, sodium vapor) 4. Non -empty aerosol cans 5. Mercury Switches 6. Mercury thermometers 7. Pressure or vacuum gauges (mercury containing manometers, barometers) 8. Dilators and weighted tubing (medical) 9. Rubber flooring (older gym floors) 10. Novelties containing mercury or mercury batteries 11. Mercury gas flow regulators 12. Counterweights and dampers 13. Dental amalgam 14. Consumer electronic devices (cell phones, game consoles, computers) 15. Cathode ray tubes (CRTs) A fully comprehensive program would address all of these wastes. In support of the District Public Outreach and Education program, the most common of these wastes everyone comes in contact with are batteries, lamps, and aerosol cans. This Memo outlines a Pilot program to address recycling batteries at District schools. + DISCUSSION: The most direct impact in educating our customers' children is most likely through a battery recycling program, to which other programs may be attached. Director Dan Worthington and Asst Mgr Tom Fauth visited Toxco, Inc., a battery recycler, located in Anaheim, CA. Kinsbursky Brothers, Inc., is a battery recycler located in Anaheim with a controlling interest in Toxco Inc. Toxco has initiated a program for battery and portable electronics recycling called "The Big Green Box." Staff proposes the following Pilot program to be tested in selected District schools: 1. Number of schools: 10 (2 high, 4 middle, 4 elementary schools) 2. Schedule: mid -April 2004 — mid -June 2004 (2 months) 3. Cost: 10 schools x 8 boxes /school x $52.50/box = $4,200 4. School Approval: NMUSD Authorization for 10 selected schools. 5. Benefit: Education to District school children, Public Awareness at homes, testing program documenting the concept as a proactive approach to meeting the February 9, 2006 diversion requirement. 6. If items 1 -5 above are deemed acceptable to the Board, District Counsel Alan Burns will have to determine through correspondence with Toxco and Kinsbursky Brothers whether their recycling guarantees, indemnification and insurance meet District standards. SUMMARY AND RECOMMENDATION: The Pilot program is designed to test 10 schools over a two -month period (8 weeks — mid -April — mid -June 2004; 2 boxes at each school every two weeks) with a natural ending date of mid -June, coinciding with the start of summer vacation. Estimating one box per week at each of 10 schools provides a reasonable database to determine follow -on program activity, at a cost of $4,200. The funds are available in the District budget under the Household Hazardous Waste (HHW) Program line item shown as: Account: 555102 Fund: 594 Organization: 80000 Program: 20210 This fund was budgeted at $24,000 for FY03 -04 for Curbside to collect HIM. The first six months of Curbside costs are average $1300 /month resulting in a budget savings of $700 /month, for a total available funding for the battery pilot program of $4200 to date. The current runout rate for Curbside could yield an additional $4200 of available funds over the next six months for similar efforts or program expansion. A successful program could lead to a shared partnership with retailers and potential CR &R funding of the program to assist CR &R in ensuring the u -waste is removed from the waste stream. 1 Atch, Draft CMSD -The Big Green Box Agreement _, Agreement To Recycle Batteries and Portable Electronics Between Costa Mesa Sanitary District and Toxco Inc. Toxco Inc also dba The Big Green Box agrees to recycle batteries received from the Costa Mesa Sanitary District (CMSD). This recycling shall recover usable products from the batteries and they shall not be placed in a landfill or sent for incineration. In addition to this, transportation, packaging, handling, storage, and recycling shall be in accordance with requirements of the US EPA guidelines listed in Code of Federal Regulations (CFR) 40 "Protection of the Environment" (latest revision) and the US DOT guidelines listed in CFR 49 "Transportation of Hazardous Materials" (latest revision). Toxco facilities, Toxco contractors, consolidation and storage areas, parent companies, and affiliated companies which may be utilized to recycle batteries and electronics shall be responsible for all permits and authorizations necessary to remain current with the requirements of the California Department of Toxic Substances, US Environmental Protection Agency, US Department of Transportation, and the Canadian Ministry of the Environment (if battery processing is performed in Canada). Toxco (or the affiliated receiving facility) shall issue Certificates of Acceptance and Guaranteed Recycling when the material is received from CMSD. Toxco (or the affiliated recycling facility) will issue Certificates of Recycling upon the actual recycling or the batteries or electronics. These Certificates will be issued upon request by CMSD.
