Ord 2007-59ORDINANCE NO. 59 AN ORDINANCE OF THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT INCREASING DIRECTOR COMPENSATION WHEREAS, the Directors of the Costa Mesa Sanitary District are entitled to compensation for their service on behalf of the district as provided in Health & Safety Code Section 6489; and WHEREAS, the Board has been compensated at the rate of $170 per day of service on behalf of the District, up to a maximum of six days per month, since 2001; and WHEREAS, the Legislature has provided that directors are entitled to increases in compensation of up to 5% per year thereafter; and WHEREAS, the Board has never determined to increase its compensation in those six years, and the sum of $170 per day's service is now worth significantly less because of inflation; and WHEREAS, the Board has conducted a public hearing on this matter in accordance with the procedure set forth in Water Code Section 20203, and notice of this matter has been duly published in accordance with Government Code section 6066; NOW, THEREFORE, it is hereby ORDAINED as follows: Section 1. That Section 3.01.30 of the Costa Mesa Sanitary District Operations Code is hereby amended to read: "3.01.030. Compensation. Pursuant to the provisions of Health and Safety Code Section 6489, compensation is set for each day's attendance at a Board meeting, or for each day's service rendered as a Director at the request of the Board, the sum of two hundred twenty one dollars per day, not to exceed a total of six days in any calendar month." Section 2. Should any part, clause or section of this Ordinance be declared by any Court of competent jurisdiction to be invalid, the remaining provisions of this Ordinance shall nevertheless be and remain in full force and effect and the Board of Directors of the Costa Mesa Sanitary District of Orange County, California, hereby declares that each and every section, clause, provision or part of this Ordinance would have been adopted and made a part of this Ordinance without the adoption of any portion thereof and that the invalidity of any part or provision hereof shall not in any way affect the validity or enforcement of the remaining provisions of this Ordinance that may stand on their own. Section 3. Pursuant to Health and Safety Code Sections 6490 and 6491.3, the Clerk shall cause this ordinance or a summary thereof to be published in a newspaper of general circulation printed and published in the District according to law. Section 4. In accordance with Water Code Section 20204, this ordinance shall only become effective 60 days after the date of its passage. PASSED and ADOPTED this day of 2007.
