Ord 2005-51ORDINANCE NO. 51 AN ORDINANCE OF THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT IMPOSING A PERMIT REQUIREMENT FOR FOOD SERVICE ESTABLISHMENTS PERTAINING TO GREASE CONTROL WHEREAS, the District has enacted a "fats, oils and grease" (hereinafter "FOG ") ordinance in response to Order No. R8- 2002 -0014 of the Santa Ana Regional Water Quality Control Board that required that local agencies adopt such regulations to reduce sewage spill overflows; and WHEREAS, the District does hereby desire to implement a permit system for such food service establishments; NOW, THEREFORE, the Board of Directors does hereby ORDAIN as follows: Section 1. That Section 7.09.044 is hereby added to the Costa Mesa Sanitary District Operations Code to read: "Section 7.09.044 Permit required. No Food Service Establishment shall discharge into the District's system without obtaining a permit from the District describing the business operations and discharge and any FOG prevention measures being undertaken or to be undertaken to reduce the discharge of FOG into the District's system in accordance with this chapter." Section 2. The prohibition on discharging without a permit shall be operative as to existing businesses 90 days after the effective date of this Ordinance." Section 3. Pursuant to Health and Safety Code Sections 6490 and 6491.3, the Clerk shall cause this ordinance or a summary thereof to be published in a newspaper of general circulation printed and published in the District according to law and it shall take effect upon the expiration of one week after publication. Section 4. Should any part, clause or section of this Ordinance be declared by any Court of competent jurisdiction to be invalid, the remaining provisions of this Ordinance shall nevertheless be and remain in full force and effect and the Board of Directors of the Costa Mesa Sanitary District of Orange County, California, hereby declares that each and every section, clause, provision or part of this Ordinance would have been adopted and made a part of this Ordinance without the adoption of any portion thereof and that the invalidity of any part or provision hereof shall not in any way affect the validity or enforcement of the remaining provisions of this Ordinance that may stand on their own. Section 5. Pursuant to Health and Safety Code Sections 6490 and 6491.3, the Clerk shall cause this ordinance or a summary thereof to be published in a newspaper of general circulation printed and published in the District according to law and it shall take effect upon the expiration of one week after publication.
