Ord 2004-47ORDINANCE NO. 47 AN ORDINANCE OF THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT ESTABLISHING PROCEDURES FOR PAYMENTS Recitals WHEREAS, the Costa Mesa Sanitary District ( "District ") was previously integrated into the City of Costa Mesa ( "City ") and utilized the services of the City's Finance Department in paying claims; and WHEREAS, the District separated from the City on July 1, 2004 and has retained its own Treasurer and desires to take control of its own finances; and WHEREAS, the District does hereby desire to provide procedures to allow for the payment of certain money as hereinafter provided in accordance with Government Code Section 53910; NOW, THEREFORE, the Board of Directors of the Costa Mesa Sanitary District does hereby ORDAIN as follows: Section 1. That Chapter 4.07 is hereby added to the Costa Mesa Sanitary District Operations Code to read: "Chapter 4.07 - Payments 4.07.010 Purpose. This Chapter enacts procedures for the payment of claims consistent with Government Code Section 53910 et seq. 4.07.020 Payments Conforming to Budget. The District Board of Directors delegates to the Treasurer the approval of all warrants, including payroll, for which adequate appropriations have been previously approved and adopted by the Board. The Treasurer is required to subsequently submit to the Board a detailed listing of those warrants, excluding payroll, previously approved and released by the Treasurer. The payroll warrants will be aggregated and submitted in total to the District Board of Directors at the next regular Board meeting. 4.07.030 Audit Procedure. The Board of Directors shall audit and ratify all payments on their warrant register each month or at such other intervals as it shall determine." Section 2. Should any part, clause or section of this Ordinance be declared by any Court of competent jurisdiction to be invalid, the remaining provisions of this Ordinance shall nevertheless be and remain in full force and effect and the Board of Directors of the Costa Mesa Sanitary District of Orange County, California, hereby declares that each and every section, clause, provision or part of this Ordinance would have been adopted and made a part of this Ordinance without the adoption of any portion thereof and that the invalidity of any part or provision hereof shall not in any way affect the validity or enforcement of the remaining provisions of this Ordinance that may stand on their own. Section 3. Pursuant to Health and Safety Code Sections 6490 and 6491.3, the Clerk shall cause this ordinance or a summary thereof to be published in a newspaper of general circulation printed and published in the District according to law and it shall take effect upon the expiration of one week after publication.
