Minutes - Board - 1956-05-17MINUTES OF REGULAR ADJOURNED MEETING BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT HELD AT 111 EAST 20TH STREETs COSTA MESA, CALIFORNIA May 17s 1956 Roll Call Present: Directors Meyers, Norman, Nelson and Porter Absent:-Director Hollister Officials PresentS Engineer Southworth, Street Foreman Heller, Attorney Dungan, Fiscal Officer Hartzler, and Special Attorney Brown The meeting was called to order by President Meyers at 7:30 p.m. Minutes Upon motion of Director Normans seconded by D. Nelson, and unanimously carried the minutes were approved as mailed. Annexations The Engineer presented to the Board plans, specifications, and map show® #21'and #22 ing the boundary of the assessment district to be assessed for the con- s$ ruction of sanitary sewers and appurtenances and appurtenant work in Annexations No. 21 and No. 22 to the Costa Mesa Sanitary District. On motion of Director Nelson, seconded by Director Norman, Resolution No. 19 entitled, "RESOLUTION OF THE BOARD OF THE COSTA MESA SANITARY DISTRICTS ORANGE COUNTY, CALIFORNIA,, ADOPTING PLANS, MAP AND SPECIFI. CATIONS., FOR THE CONSTRUCTION OF SANITARY SEWERS AND APPURTENANT WORK IN ANNEXATIONS N0, 21 and NO. 22 TO SAID DISTRICT." was adopted by the following roll call votes AYESs Directors Meyers, Normans Nelson and Porter NOES: None ABSENT: Director Hollister Communication® The secretary announced that the Board had heretofore received from Orange County the Health Officer serving said Board a written report stating the Health Dept. necessity for the construction of sanitary sewers and appurtenances and appurtenant world in Annexations No. 21 and No. 22 to said Sanitary District; that he has been advised by the Special Counsel that in order to proceed further, such letter should be spread in full upon the Board minutes. On motion of Director Nelson, seconded by D. Porters and unanimously carried, the said report of the Health Officer was ordered spread in full upon the minutes. Box 355 May 99 1956 Costa Mesa Sanitary District City Hall Costa Mesa., California Gentlemens As Health Officer of the City of Costa Mesa and the County of Oranges I hereby recommend that proceedings should be instituted at once for the construction of sanitary sewers in that portion of Costa Mesas described as follows: 1. Annexation Noe 21 which consists of the unsevered portions of the area bounded by Canyon Drives Hamilton Street Harbor Boulvard$ and a line parallel to and approximately go feet north of Wilson Street. 2. Annexation No. 22 which consists of an area bounded by Hamil- ton Streets Pomona Avenues 19th Streets and a line parallel to and approximp tely 130 feet east of Federal Avenue, This recommendation is made as a measure necessary to the protection of public health and is also made pursuant to Section 2808 of the State Highways Code of the State of California, We have made an investigation of the Sanitary conditions in this area of the city and we have found that residents therdin have been and are experiencing difficulties with their individual disposal systemso EEFsE Yours very truly: EDW. Frisby, Chief Division of Sanitation ._. ate' • e -),.uri.on #20 On motion of Board Menber Norman, seconded by Board member Porter., Resolution No, 20, entitled$ "RESOLUTION OF THE BOARD OF THE COSTA MESA SANITARY DISTRICT, ORANGE COUNTY,, CALIFORNIA9 ADOPTED PURSUANT TO THE PROVISIONS OF SECTION 280$ OF THE 1 1SPECIAL ASSESSMENT INVESTI•., GATION., LIMITATION AND MAJORITY PROTEST ACT OF 19319., BEING DIVISION 4 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIAN was adopted by the following roll call votes AYES: Directors Meyers., Nelson, Noriran, and Porter NOES: None ABSENTs Director Hollister Special counsel announced that inasmuch as a portion of the district to be assessed for the improvement•is located partly in the City of Costa Mesa and partly in the County of Orange,, the consent of the City Council of the City of Costa Mesa and of the Board of Supervisors of Orange County would have to be obtained before the adoption of a Reso- lution of Intention and presented to the Board a Resolution requesting the consent of the said City Council and said Board of Supervisors to the assumption of jurisdiction and to the doing of the works, Resolution #21 On motion of Director Norman, seconded by Do Nelson, neso:ution,No. 21 entitled., "RESOLUTION OF THE BOARD OF THE COSTA MESA SANITARY 01STRICT, ORANGE COUNTY, CALIFORNIA., APPROVING A PROPOSED RESOLUTION OF INTENTION FOR THE CONSTRUCTION OF SAPITARY SEWERS AND REQUESTING CONSENTS TO THE CONSTRUCTION OF SAID S94EERS AND THE ASSESSING OF PROPERTY-70R. THE PAY.- MENT THEREOF," was adopted by the following roll call votes AYES: Directors Meyers, Nelson, Norman, and Porter NOES: None ABSENT: Director Hollister After discussion it was agreed to hear the Resolution of Intent on July 5 and advertise for bids that night and receive bids July 26, 19560 Insurance Bid Mr, Henry Vaughn was present to discuss insurance coverage with the board, After full and complete discussion it was moved by D. Porter, seconded by Do Norman, and unanimously carried that the board accept the proposal as set forth by Mr. Vaughn for the Great American Idemnity Insurance Co, Bonds - Annexations The board requested that Attorney Dungan take the necessary steps to have #139 159 and 17 the bonds sold-for Annexations 13, 15, and 17, Resolution #22 Street Foreman Heller announced to the Board that during the next year their will be approximately 2,291 additional residential units to collect. trash and garbage for. After full and complete discussion it was"noved "° by Director Nelson, seconded by D, Norman that Resolution #22! "ESTABLISHING A SERVICE CHARGE FOR GARBAGE AND TRASH COLLECTION ", was adopted by the following roll call votes AYES: Directors Meyers, Nelson, Norman, and Porter NOES: None ABSENTS Director Hollister Rheinking & Penfd1l Director Meyers reported that he and Director Nelson had contacted the Annexation property owners in this area-, 'It vas` agreed by all concerned that further work on the annexation will be held up until June 7, however if a decision is not reached by that time the board will proceed as preen viously planned, M After further discussion it was agreed that Attorney Dungan draft a letter to send to the people who attended the meeting. AUDIT OF ACCOUNTS At a regular meeting of the City Council, held on Monday, May 7, 19560 the Council concurred that it would be to the best interest of the City to have a complete audit-of Sanitary District records made by the City Auditors, Pyle, Lance & Schlin ?er, at the same time they make their audit of City accounts. It w as felt that since certain checks must be made against Sanitary District records anyway, the charge for this additional service would be nominal.
