Ord 1994-25ORDINANCE NO. 25 AN ORDINANCE- OF THE BOARD OF DIRECTORS OF THE COSTA MESA SANI- TARY DISTRICT REGULATING MULTIPLE SINGLE FAMILY SERVICES ON A SINGLE LATERAL CONNECTING TO THE MAINS OF THE DISTRICT AND SETT ING FORTH REASONS THEREFOR. THE BOARD OF DIRE CTO RS OF THE COSTA MESA SANITARY DISTRICT DOES HEREBY FIND AS FOLLOWS: THAT within the District several conditions exist whereby multiple single family services connect to a single lateral joining District mains within public streets; _ THAT the Board further finds and declares that such installations leave the responsibility for repair, maintenance and upkeep undecided; THAT the Board further finds and declares that when remodeling major proj- ects, it is an appropriate time to require that said multiple single family ser- vices be discontinued and single services be installed. SFrTTnN 1 _ ACCORDINGLY, the following Sections are hereby adopted by the Board: 1. Multiple single family services on a single lateral are hereby pro- hibited and District will not approve said construction nor authorize connections with any lateral connected to multiple services to the mains of the District with- in the public right -of -way, unless as otherwise noted in paragraph 4 below. 2. Repair, maintenance and upkeep of said lateral connected to multiple services shall be the joint responsibility of all multiple services connected to said lateral. 3. Major remodeling or construction of any residence served by _a multi- ple service may be required by the Board to install a single lateral to the Dis- trict's facilities in the public right -of -way. 4. The District may, at its option, accept multiple services connected to a single lateral in public right -of -way so long as all owners connected thereto form a governing body capable of obligating itself to the District for repair, maintenance and upkeep of the lateral in public right -of -way and on private prop- erty. gact i nn 9 _ Pursuant to Sections 6490 and 6491.3, Health & Safety Code, the Secretary of the District shall certify to the passage of this Ordinance and shall cause the same to be published once in the Orange Coast Daily Pilot, a newspaper of general circulation printed, published and circulated in the Costa Mesa Sanitary District, Orange County, California, and seven ( 7 ) days after its- publication, it shall be in full force and effect.
