THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT OF ORANGE COUNTY, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The Board of Directors of the .Costa Mesa Sanitary District of Orange County, California finds and declares that surcharges for the use of the facilities of the District exceeding fifteen thousand (15,000) cubic feet per acre per month, said charges having been established in 1969, are no longer adequate to provide for repair, maintenance, upkeep, and replacement of facilities necessitated by said excessive use. The Board further finds and declares that any reference to a classification of properties by reason of the ad valorem tax is no longer a valid method of classifying properties insofar as surcharges are concerned. The Board further finds and declares that in- creases in the Consumer Price Index from 1969 to 1984 are one of the criterion used in determining the inadequacy of surcharges. the boara rurtiner I111u." Qllu declares that substantial costs in sewage facility construction have occurred since 1969 when original surcharges were established necessitating an increase in said charges. The Board further finds and declares that the health, safety and welfare of the community will not be adequately served unless said surcharges are increased. Accordingly, Ordinance No. 6 of the Costa Mesa Sanitary District is hereby amended to read as follows: SECTION 2. "ARTICLE 2 — PERMIT REGULATIONS (c) (3) Surcharges for Use Permit.
