Ord 1983-181 fl l i 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19' 20 21 22 23 24 25 26 27 28 29 30 31 32 ORDINANCE NO. 18 AN ORDINANCE OF THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT OF ORANGE COUNTY, CALIFORNIA, OVERRULING PROTESTS TO THE PROPOSED CHARGES FOR LIQUID WASTE DISPOSAL AND ADOPTING THE REPORT PREPARED AS REQUIRED BY LAW. THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT OF ORANGE COUNTY, CALIFORNIA, HEREBY ORDAINS AS FOLLOWS: The Board of Directors of the Costa Mesa Sanitary District finds and declares that an ordinance providing for the collection of user fees with the general taxes, pursuant to Section 5473 of the Health & Safety Code, was passed and adopted on the 12th day of May, 1983 at a regular meeting of said Board. The Board further finds and declares that, pursuant to said Ordinance, a public hearing was set for the 9th day of June, 1983 to be heard in the Council Chambers of the City of Costa Mesa at 77 Fair Drive, Costa Mesa, California; at the hour of 7:30 P.M. The Board further finds and declares that, pursuant to said Ordinance, the Clerk has caused notice of said hearing to be published in a newspaper of general circulation within the District as required by law and has caused written notice of said public hearing to be mailed, postage prepaid, to each owner of the separate parcels of property described in the report. The Board further finds and declares that 23,841 assessor's parcels are being considered in connection with this hearing. The Board further finds and declares that after hearing all objections pursuant to Section 5473.2 of the Health & Safety Code, that written objections and those parties objecting in person do not constitute the owners of a majority of the separate parcels of property described in the report. Accordingly, pursuant to the powers of the District as set forth in Article 4, Chapter 6, Part 3, Division 5, consisting of Sections 5470 through and including 5474.10, and Section 6520.5 of the Health & Safety Code and other applicable laws, rules and regulations, the following Sections are adopted: SECTION 1. The protests lodged in person and in writing at the time of the public hearing are numerically insufficient to constitute the owners of a majority 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19i 20 21 22 23 24 25 26 27 28 29 30 31 32 of the separate parcels of property described in the report and are hereby overruled. SECTION 2. The report and the map prepared in accordance with Ordinance No. 17 as prepared, or if modified, or changed as a result of the public hearing is hereby adopted. SECTION 3. The Clerk is instructed to file a copy of the report and map with the County Auditor within the time prescribed by law to insure the collection of user fees for liquid waste disposal in accordance with these proceedings. SECTION 4. In subsequent years the user fees provided for.pursuant to this Ordi- nance may be adjusted by resolution after public hearing duly noticed, as provided for by law. SECTION 5. Pursuant to Sections 6490 and 6491.3, Health & Safety Code, the Secre- tary of the District shall certify to the passage of this Ordinance and shall cause the same to be published once in the Orange Coast Daily Pilot, a news- paper of general circulation printed, published and circulated in the Costa Mesa Sanitary District, Orange County, California, and seven (7) days after its publication, it shall be in full force and effect.
