Ord 1980-15�a ®mo © -,/y /Pq 1 ORDINANCE NO. 2 AN ORDINANCE OF THE BOARD OF DIRECTORS OF THE COST MESA SANITARY DISTRICT, AMENDING 3 ORDINANCE NO. 6, RELATING TO RULES AND REGULATIONS FOR THE CONNECTION TO DISTRICT'S 4 CIVIC FACILITIES, AND PROVIDING FOR AN EXEMPTION THEREFROM. 5 6 THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY i ISTRICT, ORANGE COUNTY, CALIFORNIA DOES HEREBY ORDAIN AS FOLLOWS: 8 SECTION 1. The Board of Directors of the Sanitary Dis- 9 rict finds and declares that in some instances developers within 101fthe District have connected their sewer laterals directly into the 11 lines of Sanitation District No. 6; that the obligation for re- 12 placement of sewer facilities, installed and owned by Sanitation 13 District No. 6 is not the obligation of the Costa Mesa Sanitary 1410istrict; that Ordinance No. 6 and the amendments thereto have 15 limited the expenditure of funds collected, pursuant to said 16 Ordinance, exclusively to the facilities replacement; that inasmuch 17 as the Costa Mesa Sanitary District has no obligation to replace 18 Sanitation District No. 6 facilities, said charge imposed by 19 Ordinance 6 are inequitable and would be unfairly charged against 20 any developer or person connecting laterals directly to Sanitation 21 District No. 6 lines. 22 Accordingly, Ordinance No. 6 of the Costa Mesa Sanitary 2311District is hereby amended to read as follows: 241 251 M1 SECTION 2. Article 2 Permit Regulations, Subsection (b) is hereby amended to read as follows: "Condition Precedent. No permit shall be valid unless 27 the real property to be sewered by use of the permit shall be in- 2 8 cluded within the boundaries of the District or which is currently 29 30 31 321 ing annexed to the District or unless said property is subject to or is being made subject to a service contract between the real property owne.r and the District. Any owner or developer of proper- qty within the geographical boundaries of the Costa Mesa Sanitary -1- 10 1 District who sewers said property by a direct connection of sewer 2 laterals to the facilities of Sanitation Districts No. 6 and 7 3 within the Costa Mesa Sanitary District, shall be exempt from the 4 requirements of this Ordinance and the fees to be paid thereunder." 5 SECTION 3.
