Ord 1972-10i Z ORDINANCE NO. 10 2 AN ORDINANCE OF THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT, AMENDING 3 ORDINANCE NO. 6,. RELATING TO RULES AND REGULATIONS FOR CONNECTION TO DISTRICT'S 4 CIVIC FACILITIES, AND PROVIDING FOR AN EXEMPTION THEREFROM. 5 6 THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY 7 DISTRICT, ORANGE COUNTY, CALIFORNIA DOES HEREBY ORDAIN AS FOLLOWS: 8 SECTION 1. The Board of Directors of the Sanitary 9 District finds and declares that in some .instances developers 10 within the District have tied their sewer laterals directly into 11 the lines of Sanitation District No. 7; that the obligation for 12 replacement of sewer facilities, installed and owned by Sanitation 13 District No. 7 is not the obligation of the Costa Mesa Sanitary 14 District; that Ordinance No. 6 and the amendments thereto have 15 limited the expenditure of funds collected, pursuant to said 16 Ordinance, exclusively to facilities „replacements; that inasmuch 17 as the Costa Mesa Sanitary District has no obligation to replace 18 Sanitation District No. 7 facilities, said charge imposed by 19 Ordinance 6 are inequitable and would be unfairly charged against 20 any developer or person connecting lateral directly Sanitation 21 District No. 7 lines. 22 Accordingly, Ordinance No. 6 of the Costa Mesa Sanitary 23 District is hereby amended to read as follows: 24 SECTION 2. Article 2 - Permit Regulations, Subsection 25 (b) is hereby amended to read as follows: 26 "Condition Precedent. No permit shall be valid unless 27 the real property to be sewered by use of the permit shall be 28 included within the boundaries of the District or which is 29 currently being annexed to the District or unless said property 30 is subject to or being made subject to a service contract between 31 the real property owner and District. Any owner or developer of 32 property within the geographical boundaries of the Costa Mesa - 1 - y 1, 1 2I 3! 41 5 6 7 8 9 10 11 12 13 14 15 16 17 181 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Sanitary District who sewers said property by a direct connection of sewer laterals to the facilities of Sanitation District No. 7 within the Costa Mesa Sanitary District, shall be exempt from the requirements of this Ordinance and the fees to be paid hereunder." SECTION 3.
