Reso 2009-766r r RESOLUTION NO. 2009-766 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT DECLARING THAT VOLUNTEERS PERFORMING SERVICES FOR THE DISTRICT WITHOUT PAY ARE HEREBY DEEMED TO BE EMPLOYEES FOR THE PURPOSES OF THE WORKERS' COMPENSATION LAW WHEREAS, the District has from time to time allowed volunteers to perform services for the District; and WHEREAS, said volunteers perform said services without compensation; and WHEREAS, volunteers generally do not receive workers' compensation coverage; and WHEREAS, Labor Code Section 3363.5 provides that a public agency may make such volunteers subject to the workers' compensation laws, extending "employee" status to such volunteers; NOW, THEREFORE, the Board of Directors of the Costa Mesa Sanitary District does hereby RESOLVE as follows: 1. That volunteers shall be deemed to be "employees" of the Costa Mesa Sanitary District for the purposes of the workers' compensation laws; and 2. That no other benefits are intended by such action and such volunteers shall not be entitled to any other fringe benefit provided to District employees. This Resolution shall take effect upon its adoption. PASSED AND ADOPTED by the Board of Directors of the Costa Mesa Sanitary District at a regular meeting held on the �21XL day of 2009.
