This hybrid in -person and teleconferenced meeting will utilize electronic means consistent with State of California Assembly Bill 361 (Gov. Code § 54953(b)(3)). A. OPENING ITEMS Procedural: 1. Call to Order Citizens Advisory Committee (CAC) Chair Katz called the meeting to order at 6:05 P.M. Roll Call District Clerk & Public Information Officer, Noelani Middenway, conducted roll call. She noted that CAC Members Arbour, Chora, Fernandez, Fisher, Gielow, Katz, Lester, and Tou were present, while CAC Members Baume, Brenneman, and Watson were not present at this time. Procedural: 3. Public Comments - Speakers will be limited to three minutes. The three minutes per speaker time allotted may be extended for good cause by a majority vote of the committee. CAC Chair Katz opened public comments. Hearing none, she closed public comments. B. ITEMS Action: 1. Approve the Citizens Advisory Committee Meeting Minutes of July 13, 2022 Recommendation: That the Citizens Advisory Committee approves the meeting minutes as presented. CAC Chair Katz discussed an agenda item that was supposed to be discussed at the previous CAC meeting regarding the CAC's workplan. General Manager, Scott Carroll, provided more information regarding the CAC's workplan. He stated that a CAC member will need to issue a motion to take emergency action to review the 2022-23 CAC workplan. CAC Member Baume entered the meeting at 6:07 p.m. Motion: To review the Citizens Advisory Committee's 2022-23 workplan. Motion by Elodie Katz, seconded by Dean Fisher. She noted that most CAC meetings will discuss Senate Bill (SB) 1383. She reviewed the topics of future CAC meetings for 2022-23. CAC Member Chora commented on the topics listed for the March 2023 CAC meeting. CAC Vice Chair Lester asked if the CAC will discuss the District's enforcement measures for SB 1383. Mr. Carroll stated the District is not required to issue fines related to SB 1383 until 2024. He noted that the District will continue its SB 1383 education efforts in 2022-23. CAC Vice Chair Lester suggested adding the topic of Code Enforcement procedures to the 2022-23 work plan. CAC Member Chora inquired about SB 1383 education and outreach as part of the 2022-23 work plan. CAC Chair Katz stated that the CAC will be discussing that topic throughout 2022-23. CAC Member Chora suggested adding an education item related to Code Enforcement. CAC Chair Katz introduced Item B1. Consider Appointing Two CAC Members to Serve on the Policy Review Ad Hoc Committee Recommendation: That the Citizens Advisory Committee appoints two members to the Policy Review Ad Hoc Committee. CAC Chair Katz introduced the item. Mr. Carroll provided more information on the Policy Review Ad Hoc Committee. CAC Chair Katz asked if any Board members have been appointed to the committee. Mr. Carroll stated that the District will be requesting Board appointments later this month. CAC Vice Chair Lester offered to join the Policy Review Ad Hoc Committee. Mr. Carroll stated that committee members will be reviewing policies on their own time and then meeting to discuss any proposed changes. He added that committee meetings will be approximately one hour. CAC Member Fisher offered to join the Policy Review Ad Hoc Committee. Motion: To appoint CAC Vice Chair Sue Lester and CAC Member Dean Fisher to the Policy Review Ad Hoc Committee. Motion by Elodie Katz, second by Dean Fisher. Action, Receive and File: 3. Receive and File Waste Composition Study #3 from Michael Balliet Consulting Recommendation: That the Citizens Advisory Committee receives and files this report. Mr. Carroll introduced the item and Mike Balliet of Michael Balliet Consulting. Mr. Balliet presented the results on the Waste Composition Study #3. He discussed how the study's sample was selected. He noted that the purpose of the study is to identify prohibited container contaminants and cardboard and paper, which are considered organic waste according to SB 1383, and beverage containers. He reviewed the items that are labeled as general trash, food waste, recyclable containers, green waste, and other types of organic waste. He stated that this study had about 20% prohibited container contaminants. He noted that the study may utilize a different sampling methodology in the future. CAC Member Fernandez asked if additional studies will be performed on the previously sampled routes. Mr. Balliet stated that the District is trying to analyze each trash route within one year. He added that, in the following year, each route will be reanalyzed to determine if the District's education and outreach efforts are successful. He discussed SB 1383 enforcement measures that will help encourage more participation. CAC Member Baume inquired about wet cardboard and paper. Mr. Balliet stated that wet cardboard and paper may be a result of contamination from other items containing liquids or grease. He noted that the next survey will separate damp paper items from dry paper items. Discussion followed regarding the effects of humidity on paper items. COSTA MESA SANITARY DISTRICT PAGE 6 MINUTES OF THE CITIZENS ADVISORY COMMITTEE MEETING HELD SEPTEMBER 14, 2022 CAC Member Arbour stated that the purpose of this study is to determine the District's level of compliance with SB 1383 and to measure improvements. He asked if this information could be helpful in determining trash cart sizes. Mr. Balliet stated that this information can potentially lead to new cart sizes. CAC Member Fisher discussed prohibited materials. He commented that the language on the program flyer is too permissive. Discussion followed regarding the program flyer and public outreach methods. CAC Chair Katz asked if SB 1383 requires characterization studies of the Organic Recycling Carts. Mr. Balliet stated that SB 1383 focuses on prohibited container contaminants that are found in the Mixed Waste Carts since they are likely to be landfilled. Discussion followed regarding cardboard and paper being categorized as organic waste. CAC Member Arbour commented that, because SB 1383 is a climate focused policy, cardboard and paper products should be removed from landfills since they generate methane gas. He added that these materials may also be too fibrous for processing at the Anaerobic Digestor Facility. CAC Chair Katz thanked District staff for informing customers that they can request a second Organics Recycling Cart at no additional cost. Receive and File Lessons Learned from City of Newport Beach SB 1383 Roll Out Recommendation: That the Citizens Advisory Committee provide feedback and suggestions to staff. Mr. Carroll requested to discuss Item B5 prior to Item B4. COSTA MESA SANITARY DISTRICT PAGE 7 MINUTES OF THE CITIZENS ADVISORY COMMITTEE MEETING HELD SEPTEmER 14, 2022 CAC Chair Katz approved the request. Mr. Carroll introduced the item and discussed the City of Newport Beach's old trash collection system. He introduced CR&R's Senior Sustainability Coordinator, Mike Carey. Mr. Carey presented report details. He stated that CR&R's contract with the City of Newport Beach took effect in January 2022. He shared that, previously, Newport Beach residents had no restrictions regarding the amount of waste they could place outside for collection and the amount of trash carts that they could request from CR&R. He added that Newport Beach residents do not pay directly for their trash services as it is covered by the City's General Fund. He stated that, as part of CR&R's new program, Newport Beach residents can request up to 1 trash, 2 organic, and 2 recycling carts and pay extra to receive additional carts. He discussed the challenges and lessons learned from CR&R's SB 1383 roll out. He commented that the District is in a much better position than the City of Newport Beach since their Organics Recycling Program has been in effect since 2015. He provided details regarding CR&R's public outreach efforts. CAC Vice Chair Lester asked if CR&R oversees commercial waste for the City of Newport Beach. Mr. Carey stated that commercial properties are allowed to choose their own waste hauler. Discussion followed regarding CR&R's service to its commercial waste customers in Newport Beach and Costa Mesa. CAC Member Gielow asked how frequently a kitchen pail should be emptied into the Organics Recycling Cart. Mr. Carey stated that it depends on the type of items that are placed in the kitchen pail. He recommended rinsing the pail with water after each use. He shared that, as of last week, CR&R has experienced an increase in complaints regarding Organic Recycling Carts not being fully emptied into the trash truck. He noted that humidity causes the organic waste to stick to the cart COSTA MESA SANITARY DISTRICT PAGE 8 MINUTES OF THE CmzENS ADVISORY COMMITTEE MEETING HELD SEPTEMBER 14, 2022 which makes it more difficult to service. He recommended layering the waste with organic paper or mixing it with a broom. CAC Member Chora asked if the trash rates in Newport Beach support the available cart sizes. Mr. Carey clarified that organic waste and recycling carts are less expensive than trash carts. He provided the available cart sizes of each type. CAC Chair Katz inquired about CR&R's public outreach efforts in addition to their "knock and talk" program. Mr. Carey stated that CR&R has hosted community meetings and events, issued mailers, and has personally engaged with Newport Beach residents to encourage participation. There was no further discussion, and the report was received. Action: 6. Provide Comments and Suggestions to CMSD's Roll Out Plan for Implementing a 3-Cart Solid Waste Collection System Recommendation: That the Citizens Advisory Committee provide comments and suggestions to staff. Mr. Carroll requested proceeding with Item B6 before returning to Item B4. CAC Chair Katz approved the request and introduced Item B6. Mr. Carroll provided report details. He stated that the District's current Mixed Waste trash system is in compliance with SB 1383. He shared that, by 2025, the District must reduce its rate of landfilled organic waste disposal by 75%. He added that, to continue using the Mixed Waste trash system, the District is required to utilized a certified high -diversion facility. He stated that, because no waste hauler is willing to invest in developing a high - diversion facility, the District is considering a three -cart system. He shared that CR&R is currently conducting a cart audit to determine the number of carts per customer. He added that the District is now required to provide an Organics Recycling cart to customers that were previously exempt from the COSTA MESA SANITARY DISTRICT PAGE 9 MINUTES OF THE CITIZENS ADVISORY COMMITTEE MEETING HELD SEPTEMBER 14, 2022 program. He discussed the District's changes to its three -cart roll out plan, which have been approved by the Board. Discussion followed regarding SB 1383 compliance requirements. CAC Member Chora inquired about other agencies with a two -cart system. Mr. Carroll stated that are a few other agencies with a two -cart system, but most have adopted a three -cart system. CAC Member Baume asked if the three -cart system includes two trash carts. Mr. Carroll stated that the three -cart system only includes one trash cart and that there is an additional charge for a second trash cart. Discussion followed regarding cart sizes and amounts. CAC Chair Katz inquired about the District's current roll out plan. Mr. Carroll discussed the District and CR&R's education and public outreach efforts. There was no further discussion. Action: 4. Recycling 101: What Goes in the Blue Cart and Where do Recyclables Go to be Recycled? Recommendation: That the Citizens Advisory Committee receive and file this report. CAC Chair Katz introduced the item. Mr. Carroll provided report details and reviewed items that are permitted in the proposed blue carts. CAC Chair Katz inquired about some of the permitted materials included in the City of Oceanside's program flyer. COSTA MESA SANITARY DISTRICT PAGE 10 MINUTES OF THE CmzENs ADVISORY COMMITTEE MEETING HELD SEPTEMBER 14, 2022 Mr. Carroll noted that there will be inconsistencies amongst the different jurisdictions' waste programs. Discussion followed regarding the differences between the District's and the City of Oceanside's recycling programs. CAC Chair Katz inquired about rinsing out recyclables before placing them in the Mixed Waste Cart. Mr. Carroll stated that they must be rinsed and cleaned to be accepted by potential buyers like China. He noted that if they are not properly cleaned, then they are not being recycled. Discussion followed regarding proper disposal of recyclables. CAC Vice Chair Lester inquired about the delivery timeline of the blue cart. Mr. Carroll stated that, under the previous roll out plan, the blue cart was scheduled to be delivered in June 2023, but the plan has been delayed until 2025. There was no further discussion. Action: 7. CMSD's Sewer System Management Plan (SSMP) Audit Update Recommendation: That the Citizens Advisory Committee CAC Chair Katz introduced the item. Mr. Carroll stated that this item is not ready for discussion as the District is currently soliciting bids to review the Sewer System Management Plan (SSMP). There was no further discussion. C. CLOSING ITEMS Procedural: 1. Committee Member Comments COSTA MESA SANITARY DISTRICT PAGE 11 MINUTES OF THE CmzENS ADVISORY COMMITTEE MEETING HELD SEPTEMBER 14, 2022 CAC Chair Katz commented that the District is sponsoring the Newport Back Bay's Coastal Cleanup event on Saturday, September 17. Ms. Middenway provided more details regarding the Newport Back Bay's Coastal Cleanup event. She also discussed the District's upcoming Eco Expo and noted that the event will have a table for CAC members to promote the committee. CAC Chair Katz asked if the District's Eco Expo event is replacing the Citizens Environmental Protection Academy (CEPA). Ms. Middenway stated that the Eco Expo is this year's version of CEPA. She shared that the District has experienced difficulty in securing educational tours for CEPA. CAC Chair Katz expressed support for both upcoming events. She thanked District staff for taking the initiative to discuss cybersecurity at the September Study Session. There was no further discussion. Procedural: 2. Board/Staff Comments Mr. Carroll commented that this Saturday, September 17, the District's Young Southeast Asian Leaders Initiative (YEASLI) fellows will be arriving from Cambodia and Laos.
