Summary
The Board of Directors will form a temporary ad hoc committee to review District policies and ordinances to ensure the documents are up
to date with existing laws and District procedures. The last time the Board formed an ad hoc committee to review policies and ordinances
was in 2019.

Analysis
The Costa Mesa Sanitary District has three policy manuals.
1. The Administrative Regulations, which are internal procedures for administrative operations. The procedures apply to staff only.
The General Manager has the authority to approve new and/or amended administrative polices, in accordance with Operations
Code Section 3.02.060.
2. The Operations Code are local laws adopted by the Board of Directors and it’s these codes that govern CMSD. The Operations
Code applies to staff, the Board of Directors and CMSD residents.
3. The Employee Handbook is a book of rules, policies and procedures regarding personnel matters such as recruitment,
compensation and benefits, behavior standards and safety measures. The General Manager has authority to amend some
policies in the handbook, but portions of the handbook are approved by the Board as well (e.g. compensation and benefits).
The Committee will review all three manuals and report back to the CAC, and eventually the Board, with their recommended
amendments, if any. Vice Chair Sue Lester and former CAC member Monte Fields served on the 2019-20 ad hoc committee.
Legal Review
Not applicable at this time; however, District Counsel will provide comments to the Committee's suggested amendments.

Subject: Receive and File Waste Composition Study #3 from Michael Balliet Consulting
Summary
On July 13, 2022, Michael Balliet Consulting (MBC) performed a waste composition study to determine the amount of organic waste
contamination in a mixed-waste collection route. This report, along with the attachment, describes MBC findings.
Recommendation
That the Citizen Advisory Committee provide comments regarding the results of the Solid Waste Characterization Study Conducted on
July 13, 2022.
Analysis
The focus area for Study #3 included mixed waste route collecting in east side, college park and west side neighborhoods (Santa Isabel
Avenue and Wilson Street). The material was transported to CR&R's transfer station in Stanton and dumped onto a clean sorting area in
order for the material to be sorted. A total of 227.30 pounds of mixed waste was sorted into six material type categories, the categories
and their respective weights are included below:

Under SB 1383, Green Waste and Food Waste are considered "prohibited container contaminants" and it is what CMSD and CR&R will
be looking for starting in July 2023. The presence of these contaminants could result in fines to residents if the behavior is not corrected
after receiving notice from CMSD/CR&R. These waste characterization studies will result in education and outreach from CMSD staff to
help minimize contamination before SB 1383 notices and fines are officially issued in 2023. Based upon the July 13, 2022
sampling, 19.88% of the load were prohibited materials. The contaminant level from the previous two studies were as follows:
14.31% Kellybrook neighborhood
24.26% Santa Ana Heights neighborhood
The acceptable contaminant level under SB 1383 is 10%. Attached is the education and outreach material mailed to the homes that was
involved in the study.

Subject: Recycling 101: What Goes in the Blue Cart and Where do Recyclables Go to be Recycled?
Summary
The District's current recycling program consist of a mixed waste system where recyclables and refuse are discarded together in one cart
(black cart). The materials are collected and then transported to a material recovery facility (MRF) where the recyclables are picked out
of the waste stream, separated, bailed and then shipped to various markets.
Cardboard and mixed paper are recyclable materials. SB 1383, the landmark law that requires reducing organic waste disposal 75% by
2025, allows paper products to be considered organic waste. According SB 1383 regulations, paper products include, but are not limited
to, paper janitorial supplies, cartons, wrapping, packaging, file folders, hanging files, corrugated boxes, tissue, and toweling. When paper
products are discarded in a mixed waste collection system, the material is can get contaminated from refuse, which makes the material
difficult to market and can create potential challenges to achieving the State's goal of reducing organic waste by 75%.
Implementing a source separation program, where recyclables are separated from refuse and discarded in a separate blue cart, can
greatly reduce contamination, which will increase the market value of paper products and help the State achieve its organic waste
reduction goal.
Recommendation
That the Citizens Advisory Committee receive and file this report.
Analysis
The Citizens Advisory Committee (CAC) requested this item be brought back for discussion. CAC members wanted to learn more about
the source separation system, especially materials the are acceptable for discarding in the blue cart, because a source separation system
will require significant behavior change in the community. For the past sixteen years, the community has been practicing a mixed waste
collection system.
The following materials are acceptable for discarding in a blue cart.
Newspaper and magazines
Cardboard
Mixed paper
Glass
Plastic (PET & HDPE)
Aluminum
Tin/Metal
Attached are education and outreach materials to help residents understand the proper discarding method for a source separation
system (3-carts). Similar materials will need to be created when CMSD converts to a source separation system.
Recyclables, whether processed from mixed waste or source separation systems, are bailed and then shipped to various markets in
California such as Potential Industries, Inc., Ecology Recycling, Strategic Materials, Inc., and Constellium to name a few.

In January 2022, the City of Newport Beach entered into a new waste and recycling contract with CR&R Environmental Services to cover
the City's expanded recycling program. Due to SB 1383 mandating residential recycling of organic waste, from February to April 2022,
CR&R delivered green-top carts for organic waste disposal to all residential homes.
Recommendation
That the Citizens Advisory Committee provide feedback and suggestions to staff.
Analysis
In January 2022, the City of Newport Beach entered into a new waste and recycling contract with CR&R Environmental Services to cover
the City's expanded recycling program. Due to SB 1383 mandating residential recycling of organic waste, from February to April 2022,
CR&R delivered green-top carts for organic waste disposal to all residential homes.
Tonight, the CAC will receive an oral report from Mike Carey, CR&R's Senior Sustainability Manager, on the lessons learned for rolling out
the organics recycling program in the City of Newport Beach and he will describe how well residents are accepting the new program. Mr.
Carey will will also provide the CAC with recommendations/suggestions to help ensure the District remains in compliance with SB 1383.

Summary
On July 26, 2022, the District's Solid Waste Ad Hoc Committee discussed the proposed logistics and outreach plan for transitioning to a
3-cart source separating solid waste collection system.
Since March 2022, District staff and CR&R Environmental Services (CR&R) have been re-negotiating the solid waste agreement to make
it SB 1383 compliant. SB 1383, California's Short-Lived Climate Pollutant Reduction Strategy, strongly encourages agencies to use a
three-cart system (trash, recycling, organics) and CMSD will be making its transition to this system on July 1, 2023. This staff report
explains the tentative timeline of logistical plans and education and outreach that will be conducted by CMSD in anticipation of this
service change.
Recommendation
That the Citizen Advisory Committee provide comments and suggestions to staff.
Analysis
SB 1383, California's Short-Lived Climate Pollutant Reduction Strategy requires jurisdictions to provide organic waste collection services
to all residents, procure organic material such as renewable energy and compost, enforce provisions in SB 1383 to achieve the state's
climate goals, and require agencies to maintain records that demonstrate how they are complying with the law. The amendment to the
service contract with CR&R includes all parts of SB 1383 compliance but the biggest change will be the transition from a two-cart system
to the standard three-cart collection system.
The achieve the first goal, District staff and CR&R decided to push the roll-out of the three-cart system to July 1, 2023 in order to
adequately prepare for the change in service, order new recycling carts, acquire new trash trucks, and provide education and outreach to
the service area. Below is a tentative timeline of logistical plans and outreach efforts that will be performed:
Tentative Timeline
August 2022 to October 2022 – Conduct a Cart Audit.
CR&R will use a third-party vendor to complete a cart audit of CMSD's service area. The audit will take place between August 8th and
September 7th. The vendor will log the number of carts at each home by size and waste stream to compare with what is logged currently
in CR&R's system.
Audit results are expected to be available to share with the District by the end of September.
November 2022 to December 2022 – Roll out of Organic Recycling carts to currently exempt homes.
In 2015, when CMSD rolled out the Organics Recycling Program, it made it an optional program, and residents were allowed to request
exemptions. Exemptions were approved based on space constraints, not having a yard or living alone, and not creating enough food
waste. There are roughly 2,000 homes not currently participating in the program that will need to be issued an organics recycling cart and
educated on its proper use. Before carts are issued, CMSD staff will draft and mail letters to all exempt homes to prepare them for the
delivery of the cart and their first service day.
These homes will be issued 35-gallon carts which will have to be ordered because it is not the standard size and CR&R does not have
enough in stock. Enrolling all these homes also means a new route needs to be added, CR&R will need to hire a new driver and add an

January to March 2023 – Service Change Mailers.
CR&R will prepare and send mailers to all CMSD trash customers notifying them of the service change, extra cart fees, and expected
delivery date of their new recycling cart. The mailings will not begin until the last week of January 2023. The first mailing will be focused
on extra carts and giving instructions to residents to contact CR&R if they have carts that they do not want to pay for and return. Based
on a similar process used in Newport Beach earlier this year, CR&R is recommending giving trash customers 45 days to contact CR&R
before they are billed for the additional services.
In March, CR&R will send an additional mailer to residents notifying them of the three-cart system and providing a schedule of the new
recycle carts that will be delivered.
March to June 2023 – Delivery of Recycling Carts.
New recycling carts will be delivered between May and June 2023. CR&R expects the delivery of these carts will take 4-6 weeks to
complete. In June, CR&R will have an additional team place a label on all the existing mixed waste carts with landfill stickers to educate
residents on what to place in their new designated black (trash) cart. At this time, CR&R will also be removing any second or more "black"
carts that have not been agreed to be paid for by the resident.
January through June 2023 – CMSD will focus on SB1383 and three-cart system outreach. CMSD will create a dedicated webpage for
all changes in service information, boost social media posts, and create Google and Youtube Ads.
Staff has also discussed holding various town hall meetings during March and April to help prepare residents for the change in service.
July 1, 2023 – First day of new 3-cart service in CMSD

Financial Review
CR&R is proposing a monthly rate of $24.08 for the new agreement terms. CR&R's proposed monthly costs do not include the District's
overhead (e.g. salaries, benefits) and program (e.g. battery recycling, sharps collection) costs. The exact costs may change and will not
be determined until later this year when negotiations are completed.

Summary
On June 14, 2022, the Citizens Advisory Committee (CAC) approved the 2022-23 workplan that includes a list of topics the CAC will
discuss during the fiscal year. Tonight, the CAC was scheduled to review the audit findings of the District's Sewer System Management
Plan (SSMP).
Recommendation
That the Citizens Advisory Committee receive and file this report.
Analysis
Audit findings of the District's SSMP are not available for tonight's meeting because staff is currently soliciting proposals from qualified
consultants who have experience conducting SSMP audits. Audit findings will be presented to the CAC on January 11, 2023.
