Minutes - Board - 1955-06-081 ADJOURNED MEETING OF TIC BOARD OF DIRECTORS The Board of Directors of the Costa Mesa Sanitary District, Costa Mesa, California, met in adjourned regular session, 12x00 P.M., June 8, 1955, at Kennedy Is, 401 East 17th Street, Costa Mesa. The meeting was called to order by President Meyers. Roll Call Present: Directors Meyers, Nelson, Allen, Hollister. Attorney Dungan, Engineer Southworth, City Manager Coffey, C. L. Heller and Kenneth Price. Absent. Director Norman and Secretary Owen -Approval The City Manager presented a break -down of the Budget-Estimate for 1955 -56. of Budget After discussion and on motion by Director Allen, seconded by Director,Nelson 1955 -56 and unanimously carried, the budget as presented was adopted. Attorney .Dungan advised the Board that the present agreement between the City of Costa Mesa and the Costa Mesa Sanitary District, dated October 7, 1954, will expire June 30, 1955.. Thereupon on motion by Director Allen, seconded by Director Hollister, and unanimously carried; the secretary was instructed to direct a letter to the City Council requesting a renewal of said agreement. Agreement The proposed agreement between the Costa Mesa Sanitary :District and between Kenneth C. Price, contractor, was discussed.-. District & `ice Item 5 - Definition of Rubbish - It was felt that as long as rubbish is in container and weighing no more than 50 lbs. nor more than 200 lbs. per stop, that it should be collect lincluding b_ roken concrete & lawn clippings. Automotive parts are to be excluded and provision added that ashes must be entirely cool and adequately wrapped, and newspapers and magazines securely bundled and tied. Idd to paragraph on load limit - trailer courts, commercial,.manufacturing or factory establishments shall have 'a 200 lb. load limit; provided that no one container shall exceed 50 lbs. in weight. Item 6 - Frequency of Rubbish Collection - The contractor stated that a lot of difficulty arises from winds scattering papers from the truck and that* the proposed covered truck.will not eliminate all of the trouble. Addition: The District Engineer may instruct the Contractor to cancel rubbish collection during unusual weather and order collection as soon thereafter as weather permits. The Contractor requested the District to furnish the tags for marking inadequate containers - the contractor to tag the contairn rs. Item 10 - Maintenance of Schedules - Presently existing routes, schedules etc may be changed by authorization of the District Engineer9 change in schedule to be published by party requesting such change. The .District shall publish original schedule for new territories to be served. Item 11 -'Exclusiveness of Contract - The Contractor shall have the exclusive right and privilege and duty.to collect, remove and retail all � garbage and rubbish originatingBwit4in the District as defined. It was ar felt that the Sanitary District Bias the power to prohibit other barbage collectors from operating in the District. 1 Mr. Nelson said that up to and including the present time many subdividers and industrialists are unable to get necessary information regarding sewers without going through a great deal of time and trouble, due largely to the short office hours of the secretary (10.00 A.M. to noon) and also because of lack of this particular information by employees at the City Hall* He recommended that all inquiries be directed to the Engineer, Mr. Nelson also .suggested that the office of Sanitation District #6 be kept informed by sending copies of minutes to: Ora Mae Merritt, Secretary, County Sanitation District No. 6, Room 239, 1104 lies t 6th Street, Santa Ana- Upon motion by 'Director Nelson, seconded by Director Hollister; the. meeting was adjourned. Presiders Secretary SA C] Item 13 - Care of containers - The Contractor felt that a great deal of time was -Lost in replacing lids on cans and placing cans back in an upright position9..and requested that a provision be added requiring him to replace lids on cans only when they are found;. that in the provision "Garbage containers shall not be thrown from the truck to the pavement or in any way broken, damaged or roughly handled" that the word "unnecessarily"(broken) be added. The Contractor requested that the words "as demanded by the - District(( be added -to . the, provision reserving-the right of the District to withhold compensation under the .contract until any claim for damaged garbage containers has been paid or adjusted with the owners. Item 17 - Complaints - The Contractor said that it'was almost impossible to make a written report on a.complaint within 24 hours and requested that he - be allowed to make his report by phone. The Board felt that the request should be approved and that the - contract be changed to read that the Contractor "or his agent" shall report to the office of the District Engineer at least once each work day and that when the District so requests, a written report shall be made. Item 19 - Default = The Contractor requested the provision requiring him Fo pay attorney's fees in the event of default of contract_ be omitted. The Board agreed. Item 25 - Payment by District - The Contractor requested that in addition to being paid for collections per occupied units, that the following be added: "including containers located with the approval of the District /"the commercial area ". After a discussion on methods of making the actual house or occupied unit count, it was decidegbat the .District, together with a representative of.the Contractor; make the -first count upon the commencement of the 'Agreement, and that the Contractor shall report the addition of new subdivisions containing ten or more occupied houses. The Contractor advised the Board that at the present tame there is approximately a six months 9 lag-.in the count and that he has not been paid for the increase in collections. He was advised to present the matter at the next regular meeting of the Board. The Attorney was instructed to redraw the proposed Agreement. to include the above changes.
