Subject: Receive and File February 2022 Code Enforcement Officer Report
Summary
This report summarizes major points for three ordinance enforcement topics covering scavenging, graffiti on trash carts, and trash
container enforcement. For the month of February, the CMSD Interim Code Enforcement Officer focused his efforts on patrols in various
parts of the community. The goal is to identify and deter instances of scavenging and residential trash carts left within the public view.
Recommendation
That the Board of Directors receives and files this report.
Analysis
In the month of February, Interim Code Enforcement Officer (CEO) Griffin approached twelve (12) individuals after observing
them scavenging from CMSD trash carts. In the same month he issued 137 warning notices to residents storing their trash carts in public
view. The 9 homes that received red tags (2nd warning within 12 months) last month are now in compliance. Zero homes received red
tags in the month of February.
Interim Officer Griffin found no graffiti on trash carts in the month of February. Interim Officer Griffin's enforcement activities are described
in more detail in the attached report.
Legal Review

Environmental Review
Code enforcement activities and reporting are not a disturbance of the environment similar to grading or construction and do not
constitute a project under CEQA or the District’s CEQA Guidelines.

Subject: Receive and File Waste Composition Study #1 from Michael Balliet Consulting
Summary
On December 8, 2021, Michael Balliet Consulting (MBC) performed a waste composition study to determine the amount of organic waste
contamination in mixed waste collection routes. This report, along with the attachment, describes MBC findings.
Recommendation
That the Board of Directors receive and file this report.
Analysis
The focus area for Study #1 was in Newport Beach that included mixed waste route collecting on the streets of Azure Avenue, Orchid
Street and Orchid Drive. Attached is a map showing the location of the study area. The material was transported to CR&R's transfer
station in Stanton and dumped onto a clean sorting area in order for the material to be sorted. A total of 232.64 pounds of mixed waste
was sorted into three types of materials:
1. Food waste
2. Green waste; and
3. Trash and recyclables
Of the total 232.64 pounds of materials collected and sorted, 52.18 pounds was food waste, which represents 22.43% of materials
collected. In addition, 4.26 pounds, or 1.83% was green waste, and the remaining 176.20 pounds or 75.74% of the materials was trash
and recyclables.
Prior to SB 1383 becoming law, achieving 75.74% of properly segregated mixed waste would be considered a success; however, SB
1383 prohibits any amount of container contaminants. When composition studies are conducted in 2022 and beyond, the District will
place tags on carts and mail notices to homes being serviced on the entire CR&R route. The study is a representative sample of the
entire route, so all homes being serviced on the route will be receiving educational material from the District about the environmental
benefits for segregating their solid waste materials along with the consequences if the change of behavior does not occur.

Financial Review
The cost for MBC to perform the waste composition study was $1,750. This cost was budgeted in the FY 2021-22 Budget.

Summary
The Quarterly Legislative Report provides the Board of Directors with analyses of measures pending at the state and congressional
levels that are of interest to the District. On July 22, 2010, the Board of Directors gave authority to the President to write support and/or
opposition letters on behalf of the Board if that position has been taken by an agency the District is a member of. For all other bills, staff

Subject: Discuss Proposed Reissuance of Statewide Sanitary Sewer System General Order
Summary
Recognizing sewage spilled from a sanitary sewer system threatens public health, beneficial uses of water of the State, and the
environment, the State Water Board adopted the first statewide Sanitary Sewer System General Order in 2006. The Order describes how
public agencies must manage their wastewater collection system to reduce sanitary sewer overflows. The specific requirements are
described in the District's Sewer System Management Plan (SSMP), which every public agency that owns and operates at least one mile
of sewers must adopt.
State Water Board staff is now recommending amendments to the existing General Order to address the following issues:
Climate change impacts and system resilience on a system-specific level
Cost compliance
Incorporate certified professionals in the SSMP certification process
Incorporate updated electronic reporting into the California Integrated Water Quality System (CIWQS)
Clarify existing Water Code requirements and compliance expectations
Attached is the draft order. The State Water Board is expected to adopt the reissuance General Order later in 2022. The effective date of
the Reissued Order is 120 days after adoption.
Recommendation
That the Board of Directors discuss and comment on the proposed reissuance of Statewide Sanitary Sewer System General Order
Analysis
On February 23, 2022, State Water Board staff held the first of two virtual meetings to provide an overview and to answer questions
regarding the proposed General Order. The second public workshop is scheduled for March 15 and the due date to submit written
comments is on April 8, 2022. Attached is copy of the power point presentation. After reviewing the draft General Order and attending the
public workshop, staff has identified significant revisions from the 2006 Order. More information about the proposed revisions to the
General Order is described below.
1. Prohibitions
The current order states that "Any SSO that results in a discharge of untreated or partially treated wastewater to waters of the United
States is prohibited." The proposed order removes this statement and replaces with the following:
"Any discharge from a sanitary sewer system that has the potential to discharge to waters of the State is prohibited unless it is promptly
cleaned up and reported as required in the Order."
2. System Performance Analysis
The District will be required to generate a graph that describes a 10-year system performance analysis. The graph must include the total
number of spills, the total number of spills per 100 miles of the system, and total spill volume of each calendar year. The graph must be
uploaded in CIWQS on an annual basis. This is a new requirement from the proposed order. Staff has prepared a 10-year system
performance analysis, which is attached hereto.
3. SSMP Audit and Update Schedule
The current order requires SSMP to be audited once every two years and the SSMP must be updated once every five years. The
proposed order has revised the audit schedule to once every three years and updating the plan will be once every six years. The last

audit of the District's SSMP was in 2020. When the reissuance of the General Order is adopted in 2022, the next audit of the District's
SSMP will be in 2023. In addition, the SSMP was last updated in 2021. When the reissuance of the General Order is adopted in 2022, the
next SSMP update will be due in 2027.
4. Voluntary Reporting Private Sewer Spills
The proposed order is encouraging agencies to report in CIWQS private sewer spills that equal or greater than 1,000 gallons or any
volume of sewage that discharges or potentially discharges to waters of the U.S. Agencies are encouraged to identify the time of
observation, description of the spill location, estimated spill volume, spill destination and name of the private system owner. In addition,
agencies are encouraged to notify the California Office of Emergency Services if private spills of 1,000 gallons or more discharge to
waters of the State or a drainage conveyance system that discharges to waters of the state. This is a new requirement from the proposed
order. The District has typically received a half dozen reports of private sewer spills a year in which half of these report required staff to
respond because sewage has entered the street and/or the storm drain system. The District will try to recoup costs for responding to
private spills by sending property owner/management invoices for services rendered by the District.
5. Annual Report has a deadline date to submit
Under the current order, agencies must complete the “Collection System Questionnaire”, which collects pertinent information regarding an
agency's collection system. The “Collection System Questionnaire” must be updated at least every 12 months. In the proposed Order, the
"Questionnaire" has been replaced with "Annual Report. The Annual Report must address several items including updating service area
boundaries, population, number of staff, number of certified collection system operators from the California Water Environment
Association (CWEA), etc. The deadline to submit the Annual Report is April 1 of each year.
6. New and Revised Categories for Reporting Sewer Spills
The current Order identifies sewer spills into three categories:
Category 1 - Sewer spills of any volume that reach surface water and/or reach drainage channel tributary to a surface water; or sewer
spills that reach storm water system that is not fully recovered and returned to the sanitary sewer system.
Category 2 - Sewer spills equal or greater than 1,000 gallons that did not reach surface water, draining channel or a storm water system
unless the entire SSO discharged to the storm drain system is fully recovered.
Category 3 - Sewer spills that result from a failure in the agency's sanitary sewer system.
The proposed order is revising Category 3 spills to spills that are between 50 to 1,000 gallons that that did not reach surface water,
draining channel or a storm water system unless the entire SSO discharged to the storm drain system is fully recovered. Category 4 is a
new category that identifies spills that are less than 50 gallons that did not reach surface water, draining channel or a storm water system
unless the entire SSO discharged to the storm drain system is fully recovered.
7. Incentives for System-Specific Reduced Reporting
Agencies that meet the following criteria may qualify for system-specific reduced reporting for Category 4 spills.
No more than two spills per 100 miles of system per year for the last five consecutive years. In addition, the total volume of
individual spills do not exceed 1,000 gallons and the spills do not discharge to water of the U.S.
At least 50% of agency's operation and maintenance workforce is certified in Collection System Maintenance from CWEA
If approved by the Deputy Director of State Water Board, agencies may substitute reporting of Category 4 spills per instructions and
conditions in the approved letter.
8. Professional Licensing and Certification
The Legally Responsible Official (LRO) that reports spills and updates the annual report in CIWQS does not have to be a certified
registered professional engineer or a certified operator from CWEA. The general manager is the current LRO for the District. However,
updating the SSMP will require the stamp from a certified registered professional engineer or from a Certified Grade II Collection System
Maintenance operator and the stamp must be signed by the engineer or the operator. The District’s 2021 updated SSMP was certified by
the Board of Directors, which means the district engineer will need to stamp and sign the Plan the next time it's updated in 2027.
9. Electronic Service Area Boundary Map
Within twelve months of the effective date of reissuance General Order, agencies must submit to CIWQS an up-do-date electronic spatial
map of the agency's sewer system service area boundaries. The map must include major streets, city boundaries and other landmarks
necessary to appropriately identify location of service area boundaries. The map must also include the location of wastewater treatment
facilities that treats system waste. This is a new requirement from the proposed order.
10. Water Quality Sampling and Analysis
The current Order requires agencies to conduct water quality sampling within 48 hours after initial SSO notification for Category 1 SSOs
in which 50,000 gallons or greater are spilled to surface waters. The proposed Order is amending this requirement to conduct water
quality sampling within 12 hours after knowledge of the spill. In addition, agencies will be required to collect three water samples for
each day of the duration of the spill.
11. Sewer Pipe Blockage Control Program
In the current Order, this program is called, FOG (Fats, Oils and Grease) Program. This plan is being amended in the proposed Order to
address tree roots, rags and debris that cause SSOs, in addition to FOG. Agencies will be required to develop a plan to identify,

document and address system area/components prone to root intrusion potentially resulting in system backup, failure and/or exfiltration.

The proposed reissuance of the General Order is exempt from CEQA pursuant to Cal.Code Regs., title 14, §15301 to the extent that it
applies to existing sanitary sewer collection systems that constitute “existing facilities” as that term is used in Section 15301, and §15302,
to the extent that it results in the repair or replacement of existing systems involving negligible or no expansion of capacity.
Financial Review
The financial impact to the District for the reissuance of the General Order is still being determined; however, staff believes any additional
costs will be minimal because the District is already performing many of the requirements in the proposed order. For instance, an
electronic service area boundary map is already created, a 10-year system performance analysis is complete, and updating the SSMP
was performed last year. To comply with the water quality sampling and analysis will require the District retaining a laboratory company
that's available 24/7. Laboratory costs are still unknown at this time.

Copies of this report are on file and will be included with the complete agenda packet for the March 8, 2022 Board of Directors Study
Session meeting held at 290 Paularino Avenue, Costa Mesa and posted on the District’s website.
