THIRD AMENDMENT to Agreement between the Costa Mesa Sanitary District and
Environmental Engineering and Contract, Inc. for managing a FOG Control Program is
made and entered into this 21°- day of June, 2020, by and between the Costa Mesa
Sanitary District, hereinafter referred to as DISTRICT, and EEC Environmental,
hereinafter referred to as CONSULTANT.
WITNESSETH:
WHEREAS, On July 1, 2015, the DISTRICT and CONSULTANT entered into
AGREEMENT for managing the DISTRICT's Fats, Oil and Grease (FOG) Program; and
WHEREAS, on June 20, 2018, the DISTRICT and CONSULTANT extended the
term of the Agreement for one year; and
WHEREAS, on May 31, 2019, the DISTRICT and CONSULTANT extended the
term of the Agreement for one year, and
WHEREAS, the term of the AGREEMENT is scheduled to expire on June 30,
2020; and
WHEREAS, the DISTRICT and CONSULTANT now desire to amend the
AGREEMENT by extending the term for an additional one-year.
NOW, THEREFORE, the parties hereto agree as follows:
1. The AGREEMENT is hereby amended to extend for an additional one-year
period expiring on June 30, 2021.
2. The term of this Third Amendment shall become effective upon its adoption.
3. Except as specifically amended by the terms of this Third Amendment, all
provisions of the AGREEMENT shall remain in full force and effect,
IN WITNESS WHEREOF, the parties hereto have caused this Third Amendment
to be executed this day and year first above written.
