Ord 2019-129ORDINANCE NO. 129 AN ORDINANCE OF THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT AMENDING THE OPERATIONS CODE TO PROVIDE A NEW DAY AND TIME FOR THE MONTHLY REGULAR MEETINGS WHEREAS, the Brown Act provides that a legislative body of a local agency shall establish by ordinance or other rule the time and place for holding regular meetings (Government Code § 54954); WHEREAS, the Board has established its monthly regular meeting day as the fourth Thursday of the month; WHEREAS, that day and time conflicts with other public business for which certain Board members must participate; and WHEREAS, the Board of Directors does therefore determine to establish a new monthly meeting day and time for its regular meetings, beginning January 1, 2020. NOW THEREFORE, The Board of Directors does hereby ordain as follows: Section 1. That Section 3.01.060 of the Costa Mesa Sanitary District Operations Code is amended to read as follows: "Section 3.01.060. Time of Regular Meetings. The Board of Directors shall hold its regular meetings on the fourth Thursday of the month at 5:30 p.m. unless notification is otherwise given until December 31, 2019. On January 1, 2020 the regular monthly meeting day and time shall be the fourth Monday of each month at 4:30 p.m. The Board shall endeavor to conduct its business on its regular meeting date and if a meeting must be rescheduled, shall endeavor to schedule any specially set meetings to a later date. Nothing herein stated its meant to preclude the District from scheduling at an earlier date and/or time, provided notice has duly been given, when the same is determined to be in the District's best interests. Any person having business before the Board showing an acceptable excuse for not being present due to changed date, time, or place of a meeting may request the Board to reschedule the item for a subsequent meeting." Section 2. That the District Clerk shall provide advance notice of this change of day and time to the public. Section 3. Should any part, clause or section of this Ordinance be declared by any court of competent jurisdiction to be invalid, the remaining provisions of this Ordinance shall nevertheless be and remain in full force and effect and the Board of Directors of the Costa Mesa Sanitary District of Orange County, California, hereby declares that each and every section, clause, provision or part of this Ordinance would have been adopted and made a part of this Ordinance without the adoption of any portion thereof and that the invalidity of any part or provision hereof shall not in any way affect the validity or enforcement of the remaining provisions of this Ordinance that may stand on their own. Section 4. Pursuant to Health and Safety Code Sections 6490 and 6494.3, the District Clerk shall cause this ordinance or a summary thereof to be published in a newspaper of general circulation printed and published in the District according to law. The ordinance shall go into effect one week thereafter.
