RESOLUTION NO. 97 -601
A RESOLUTION OF THE COSTA MESA SANITARY
DISTRICT ORDERING THAT ORDINANCE NOS. 27 AND
28 WERE PROPERLY PUBLISHED
WHEREAS, on August 14, 1997 the Board of Directors enacted Ordinance No. 27
establishing regulations prohibiting scavenging and requiring that trash containers be promptly
removed from the curb after the regular time for collection; and
WHEREAS, on August 14, 1997 the Board of Directors also enacted Ordinance No. 28
establishing that a code enforcement officer would be authorized to enforce the District's
regulations by citation procedure; and
WHEREAS, the District Clerk has presented proof that each of the above ordinances
were properly published in the appropriate newspaper; and
WHEREAS, Health and Safety Code Section 6490 provides that if the Board makes an
order that the publication was properly made, that such order shall establish conclusive evidence
of such publication;
NOW, THEREFORE, the Board of Directors does hereby Resolve and Order that
publication of Ordinance No. 27 and Ordinance No. 28 was properly made.
PASSED AND ADOPTED by the Board of Directors of the Costa Mesa Sanitary District
at a regular meeting thereof held on the / /L day of 1997.
