Reso 1996-593RESOLUTION NO. 96 -593 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT REVISING THE PROCEDURE FOR SEATING DIRECTORS AND SELECTING OFFICERS AFTER AN ELECTION AND PRESCRIBING THE PROCEDURE FOR THE APPOINTMENT OF REPRESENTATIVES TO THE COUNTY SANITATION DISTRICTS OF ORANGE COUNTY, CALIFORNIA AND SUPERSEDING RESOLUTION NO. 92 -529 WHEREAS, the Uniform District Election Code provides, in Elections Code Section 23556, that directors take office the first Friday in December following the general district election; and WHEREAS, prior to taking office an elected director must take the oath of office; and WHEREAS, existing directors continue to serve until their successors have been qualified; and WHEREAS, the Board does therefore desire to repeal and supersede Resolution No. 92- 529 to allow greater flexibility as to whether to have a special meeting to swear -in the directors beginning a new term; NOW, therefore, be it RESOLVED as follows: THAT the Board may choose to have a special meeting on the first day of the term to "seat" the directors with a swearing -in ceremony or, in the case of directors that have been reelected to another term, may determine to have those directors simply continue to serve but to execute a new oath and comply with any other formalities that may be required; THAT at the first regular meeting at which the new Board is seated, the Board shall conduct its own election for the offices of President, Vice President, Secretary and Assistant Secretary of the Board to serve in those capacities until their successors have assumed office or a change is otherwise desired; THAT at the first regular meeting at which the new Board is seated, the President of the Board with the concurrence of a majority of the Board may appoint representatives and alternates to the County Sanitation Districts who will serve for a like period as the officers of the District; THAT the appointment of representatives and alternates to County Sanitation Districts may be reconsidered from time to time, either upon majority vote of the Board of Directors or upon request of any appointed representative or alternate to be relieved from the obligation of the appointment. THAT at such time and place such other appointments may be made including, but not limited to, the Independent Special Districts of Orange County. PASSED AND ADOPTED this !�2 Z6 day of 1996.
