Reso 1994-555RESOLUTION NO. 94- .S:S-S' A RESOLUTION OF THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT PROVIDING FOR DEVELOPER FINANCIAL PARTICIPA- TION IN INVESTIGATIONS AND STUDIES OF TBE IMPACT ON DISTRICT'S CAPITAL IMPROVEMENT PROGRAM BY DEVELOPER'S PROJECT; ESTABLISH- ING THE RESPONSIBILITY OF COST FOR INVESTIGATION STUDIES; AND PROVIDING FOR DEVELOPER PARTICIPATION IN IMPROVEMENTS REQUIRED BY ANY AMENDMENT TO DISTRICT CAPITAL IMPROVEMENT PROGRAM AND STATING REASONS THEREFOR. THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT OF ORANGE COUN- TY, CALIFORNIA HEREBY RESOLVES AS FOLLOWS: That WHEREAS, District's Capital Improvement Program may be affected by any development to the extent that said development may cause a need for offsite improvements not directly adjoining the development; and WHEREAS, a study may be necessary to determine the need for said improve- ments, capacity required, estimated cost, degree of participation reasonably required of the developer, and the impact on District facilities; and WHEREAS, the District deems it equitable that said costs determining the impact on the District's Capital Improvement Program should be borne by developer; and WHEREAS, District may require developer to participate in costs of improve - ment as well as costs of investigating and studying the impact on District's Capital Improvement Program under either of two options; NOW, THEREFORE, BE IT RESOLVED: THAT when an applicant for sewer services proposes a development which is regulated by Ordinance No: 21, the applicant may be charged a minimum fee of $1,000.00 to cover the District's costs for investigation and studying an amend- ment to the District's Capital Improvement Program; THAT in the event the District costs exceed the minimum fee, the applicant shall reimburse the District; THAT upon completion and acceptance by the Board of an amendment, District may require the applicant to participate in the cost of providing additional sewer capacity prior to any development under either of the two following options; THAT under Option 1, District may require the applicant to construct sewers as the District deems necessary in accordance with the amended Capital Improvement Program; THAT in addition the applicant shall pay all fees as are applicable under the current District ordinances including but not limited to plan check, inspec- tion and engineering supervision; THAT under Option 2, District may require the applicant to pay fees as are reasonably calculated by District in accordance with the amended Capital Improve- ment Program to meet the cost of providing additional sewer capacity; -1- THAT said fees are in addition to all other fees as are applicable under District ordinances and are due and payable when all regular fees are due and payable.
