A RESOLUTION OF THE BOARD OF DIRECTORS OF THE COSTA MESA -SANI-
TARY DISTRICT. ESTABLISHING STANDARDS FOR THE ACCEPTANCE OF
RIGHT -OF -WAY EASEMENTS OFFERED TO THE DISTRICT FOR UNDERGROUND
SEWER INSTALLATIONS AND STATING REASONS THEREFOR.
THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT DOES HEREBY
RESOLVE AS FOLLOWS:
THAT, WHEREAS, the District may require sewer facilities being constructed
on private property to provide a right -of -way easement be granted to the District;
and
WHEREAS, the District requires certain proofs before accepting said right -
of-way easements, said proofs to meet District standards; and
WHEREAS, certain conditions must be met prior to acceptance of said right -
of-way easements;
THAT no right -of -way easement for underground sewer installation shall be
accepted for processing until the following conditions have been met:
(a) Parties offering right -of -way easements shall tender said right -of-
way easements on forms approved by District Manager/Engineer and supplied by the
District;
(b) Said right -of -way easement documents are accompanied by a preliminary
title report showing the party offering the right -of -way easment to be the fee
owner thereof;
(c) Said right -of -way easement documents shall be accompanied by such
maps or plats as may be required by the District Manager /Engineer; and
THAT no right -of -way documents will be offered to the District Board for
acceptance and recording until the District Manager /Engineer has approved the legal
description and until the Attorney for the District has approved the authority of
the party signing the right -of -way easement documents to convey right -of -way ease-
ment title to the District; and
THAT permits for construction within the right -of -way easement will not be
issued until the Board has accepted the right -of -way easement documents in record-
able form as provided for herein; and
THAT any improperly tendered documents will be returned to the offering
party to be corrected; and
THAT a copy of THIS RESOLUTION be provided to any party proposing to offer a
right -of -way easement to the District.
