President TeWinkle of Sanitary District presiding
called meeting to order at 8:45 p.m.
City Attorney Dungan read in completeness a "draft"
of proposed Agreement between the City and District and County
and the matter was open for discussion or comment.
County Counsel Ogle in commenting on the proposed
Agreement indicated his views to the effect that the County was
not necessarily a party to such agreement.

City Attorney Dungan stated that they did not want
to leave the County "out" in case it wanted to be "in ", to
which Mr.Ogle replied "Well, we don't want to be ' in' . How-
ever, we (the County) will'co- operate 100% in whatever you
gentlemen want to do, but don't see where the Joint.Exercise
of Power Act ties the County, in.
Dungan - we would from our standpoint be glad to leave
you out.
Ogle - Satisfied with whatever you.- the City does.
Attorney Leroy Anderson expressed the opinion that a
contract in present form would vest full powers in the City
so far as the District is concerned and result in "killing"
any pending bond proposals and preventing such,future pro -- r'
posals by,the District.
Further discussion and a poll of the Directors of the
Sanitary District resul�ed in the following tentative con-
elusions and action: Favorable expression by each member
District Board on adoption of thel'proposalo
Exclusion of County as a a to contract.
• Refferral by both City and 'y governing bodies to
their attorneys of the matter of preparing contract and report
back Septemlx r 16th.
