A RESOLUTION OF APPLICATION BY
THE COSTA MESA SANITARY DISTRICT
REQUESTING THE LOCAL AGENCY
FORMATION COMMISSION TO TAKE
PROCEEDINGS FOR THE ANNEXATION
OF TERRITORY, BEING ANNEXATION
NO. 239
RESOLVED, by the Board of Directors of the Costa Mesa
Sanitary District, that
WHEREAS, the Costa Mesa Sanitary District desires to
initiate proceedings pursuant to the Cortese -Knox Local
Government Reorganization Act of 1985, Division 3, commen-
cing with Section 56000 of the California Government Code,
for the annexation of territory; and
WHEREAS, the territory proposed to be annexed is
uninhabited, and a description of the boundaries of the
territory is set forth in Exhibit "A" attached hereto and by
this reference incorporated herein; and
WHEREAS, it is desired to provide that the proposed
annexation be subject to the following terms and conditions:
1. Property owner to conform to all Costa Mesa
Sanitary District Ordinances, Policies, Rules and
Regulations.
2. Connection to the Costa Mesa Sanitary District
sewer system to meet all District standards.
3. Residential trash collection to meet all Costa
Mesa.Sanitary District Ordinances and Policies.
4. Applicable fees for sewer service and residential
trash collection shall apply, and
WHEREAS, the reasons for this proposed annexation are
as follows:
Annexation necessary to provide liquid waste disposal
and trash collection for users within the territory to
be annexed.
NOW THEREFORE, this Resolution of Application is hereby
adopted and approved by the Board of Directors of the Costa
Mesa Sanitary District, and the Local Agency Formation
Commission of Orange County is hereby requested to take
proceedings for the annexation of territory as described in
Exhibit "A ", according to the terms and conditions stated
above and in the manner provided by the Cortese -Knox Local
Government Reorganization Act of 1985.
PASSED AND ADOPTED by the Board of Directors of
the Costa Mesa Sanitary District at a regular meeting
thereof held on the 14th day of March, 1991.

Annexation to the Costa Mesa Sanitary District - Engineer's No. 239
That portion of the land allotted to James McFadden in Decree of
Partition of the Rancho Santiago de Santa Ana, rendered in Case
No. 1192 and entered September 12, 1868, in Book B, page 410, of
Judgements of the 17th Judicial District Court of California, in
the City of Costa Mesa, County of Orange, State of California,
described as follows;
Beginning at an angle point in the existing boundary of the Costa
Mesa" Sanitary District, said point being the southwesterly corner
of Engineer's No. 214 Annexation to said District; thence along
the existing boundary of said District as described in Engineer's
Nos. 214, 144, 180 and 115 Annexations in an easterly, southerly,
westerly and northerly direction to the point of beginning.
The above described parcel of land contains 10.4 acres.
Attached and made a part of is a map designated EXHIBIT "B ".
