Reso 1983-398RESOLUTION NO. f - f A RESOLUTION OF THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT, ORANGE COUNTY, CALIFORNIA, MAKING APPLICATION TO THE LOCAL AGENCY FORMATION COMMISSION OF ORANGE COUNTY, CALIFORNIA, FOR THE ANNEXATION OF TERRITORY TO THE DISTRICT, BEING ANNEXATION N0. 211 THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT, ORANGE COUNTY, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the Board of Directors of the Costa Mesa Sanitary District, Orange County, California, desires to initiate proceedings for the annexa- tion of the hereinafter described territory to said District; NOW, THEREFORE, the Board of Directors of the Costa Mesa Sanitary District of Orange County, California, does hereby resolve, determine and order as follows: 1. That this application is being filed pursuant to the provisions of Division 1 of Title 6 of the Government Code of the State of California for the purpose of proposing the annexation of below described property to the Costa Mesa Sanitary District. 2. That the territory proposed to be annexed contains 23.85 acres and is contiguous to the Costa Mesa Sanitary District and the territory proposed to be included in and annexed to said Sanitary District is specifically described in Exhibit "A" which is attached hereto and made a part hereof, consisting of one typewritten sheets and a map. 3. That a map showing said boundaries together with a copy of the above legal description has heretofore been filed with the Orange County Surveyor and with the Commission and has been found to be definite and certain by the Orange County Surveyor. Said map is hereby referred to and by reference made a part hereof to the same force and effect as is set out herein or attached hereto. 4. That the territory proposed to be annexed is uninhabited. 5. That the reason for the proposed annexation is to obtain and provide sewer service for the territory proposed to be annexed. 6. That the territory to be annexed is entirely located within Orange County, California. 7. That the names of all the affected districts are as follows: Orange County Sanitation District No. 7 Orange County Flood Control District Harbor District Mosquito Abatement District County Library District Metropolitan Water District Santa Ana School District 8. That the Board of Directors of the Costa Mesa Sanitary District respectfully requests the Local Agency Formation Commission of Orange County, California, to institute proceedings for the annexation of the above described territory to said District. 9. That it is further requested that the said LDCal Agency Forma- tion Commission order pursuant to the provisions of Section 56261 of the Government Code of California that this annexation be approved with- out notice and hearing by the Commission and approve and authorize the Board of Directors of the Costa Mesa Sanitary District to annex such territory without notice and hearing by the Board of Directors and without election. 10. That attached hereto is evidence of consent and request directed to the Costa Mesa Sanitary District signed by all of the owners of the land which is in such territory proposed to be annexed. 11. That the owners who signed said attached consent and request are hereby found to be the owners of 100 percent of the land described above. 12. That the proposed terms and conditions to which the proposed annexation is desired to be subject are described as follows: That all annexation fees be paid,to the District prior to this annexation becoming effective. ATTEST: Secretary Assistant Secretary -2- 5 6 7 8 9 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 a EXHIBIT "A" Page 1 of 1 ANNEXATION TO THE COSTA MESA SANITARY DISTRICT - ENGINEER'S NO. 211 I That portion of the land allotted to James McFadden in decree of partition of the Rancho Santiago De SantaiAna, recorded in Book B, page 410, of Judgements of the 17th Judicial District Court of California, more particularly described as follows: I Beginning at an angle point in the %existing boundary of the .Costa Mesa Sanitary District, said being at the northeast corner of Engineer's No. 100 Annexation to said District and the center line of Sunflower Avenue as shown on Tract No. 11762, recorded in Book 1511, pages 41 -43, of Miscellaneous Maps, records of Orange County, California; thence along the existing boundary of said District as established in Engineer's No. 100, Engineer's No. 181, Engineer's No. 100, Engineer's No. 195, and Annexation No. 18, through its various courses in a general southerly, easterly, southerly, westerly, southerly, easterly, and northerly direction to the northwest corner of said Annexation No. 18 and said center line of Sunflower Avenue; thence westerly, departing said existing boundary along said center line of Sunflower Avenue South 89026110" West 84.34 feet; thence continuing along said center line South 89009142 .West 670.04 feet to the point of beginning. The above described parcel of land contains 23.85 acres.
