A RESOLUTION OF THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT,
ORANGE COUNTY, CALIFORNIA, MAKING APPLICATION TO THE LOCAL AGENCY
FORMATION ODMMISSION OF ORANGE COUNTY, CALIFORNIA, FOR THE ANNEXATION OF
TERRITORY TO THE DISTRICTS BEING XZT-YATION NO, 207,
THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT, ORANGE COUNTY,
CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
WHEREAS, the Board of Directors of the Costa Mesa Sanitary District,
Orange County, California, desires to initiate proceedings for the annexation
of the hereinafter described territory to said District;
NOW, THEREFORE, the Board of Directors of the Costa Mesa Sanitary District
of Orange County, California, does hereby resolve, determine and order as
follows:
1. That this application is being filed pursuant to the provisions of
Division 1 of Title 6 of the Government Code of the State of California for the
purpose of proposing the annexation of below described property to the Costa
Mesa Sanitary District.
2. That the territory proposed to be annexed contains 181,02 acres and
is contiguous to the Costa Mesa Sanitary District and the territory proposed to
be included in and annexed to said Sanitary District is specifically described
in Exhibit "A" which is attached hereto and made a part hereof, consisting of
one T typewritten sheets and a map.
3. That a map showing said boundaries together with a copy of the above
legal description has heretofore been filed with the Orange County Surveyor and
with the Ccm-nission and has been found to be definite and certain by the Orange
County Surveyor. Said map is hereby referred to and by reference made a part
hereof to the same force and effect as if set out herein or attached hereto.
4. That the territory proposed to be annexed is uninhabited.
5. That the reason for the proposed annexation is to obtain and provide
sewer service for the territory proposed to be annexed.
6. That the territory to be annexed is entirely located within Orange
County, California.
7. That the names of all the affected districts are as follows:
County Sanitation District No. 7
Orange County Flood Control District
Harbor District
Mosquito Abatement District
County Library District
Metropolitan Water District
Santa Ana School District
8. That the Board of Directors of the Costa Mesa Sanitary District
respectfully requests the Local Agency Formation Commission of Orange County,
California, to institute proceedings for the annexation of the above
described territory to said District.
9. That it is further requested that the said Local Agency Formation
Commission order pursuant to the provisions of Section 56261 of the Government
Code of California that this annexation be approved without notice and hearing
by the Commission and approve and authorize the Board of Directors of the
Costa Mesa Sanitary District to annex such territory without notice and
hearing by the Board of Directors and without election.
10. That attached hereto is evidence of consent and request directed
to the Costa Mesa Sanitary District signed by all of the owners of the land
which is in such territory proposed to be annexed,
11. That the owners who signed said attached consent and request are
hereby found.to be the owners of 100% of the land described above.
12. That the proposed terms and conditions to which the proposed
annexation is desired to be subject are described as follows:
That all annexation fees be paid to the District prior to this
annexation becoming effective.

ANNEXATION TO THE COSTA MESA SANITARY DISTRICT - ENGINEER'S NO. 207
All that certain territory situated in the City of Costa
Mesa, County of Orange, State of California, being a portion of
Lot "A" of the Banning Tract in the Rancho Santiago De Santa Ana,
as shown on a Map of said Tract filed in Action No. 6385 in the
Superior Court of the State of California, in and for the County
of Los Angeles, being an action for partition entitled Hancock
Banning, et al vs. Mary H. Banning, more particularly described
as follows:
Beginning at a point in the existing boundary of the Costa
Mesa Sanitary District, said point being at the Northeast corner
of Engineer's No. 205, said point also being on the Westerly
boundary of Engineer's No. 17, and on the center line intersection
of Fair Drive and Newport Boulevard; thence along the Westerly
boundary of Engineer's No.17, Engineer's No. 60, and said center
line of Newport Boulevard North 4001552" East 2,385.42 feet to
a point common to the Southeast corner of Engineer's No. 202 and
the North line of Lot "A" of the Banning Tract; thence along said
Engineer's No. 202 and said North line West 5,100.34 feet to a
point on the center line of Fairview Road; thence along said
(center line and the existing boundary of Engineer's No. 30 South
0009 00 West-1,820.25 feet to the center line intersection of
Fair Drive; thence continuing along said boundary, said center
line of Fair Drive, and the existing boundaries of Engineer's
No. 201 and Engineer's No. 205 East 3,563.37 feet to the point
of beginning.
The above described parcel of land contains 181.02 acres.
