A RESOLUTION OF THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT,
ORANGE COUNTY, CALIFORNIA, MAKING APPLICATION TO THE LOCAL AGENCY
FORMATION COMbILSSION OF ORANGE COUNTY, CALIFORNIA, FOR THE ANNEXATION OF
TERRITORY TO THE DISTRICT, BEING DESIGNATED AS ENGINEERS NO. 180.
THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY' DISTRICT, ORANGE COUNTY,
CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
WHEREAS, the Board of Directors of the Costa Mesa Sanitary District,
Orange County, California, desires to initiate proceedings for the annexation
of the hereinafter described territory to said District;
NOW, THEREFORE, the Board of Directors of the Costa Mesa Sanitary District
of Orange County, California, does hereby resolve, determine and order as
follows:
1. That this application is being filed pursuant to the provisions of
--Division 1 of Title 6 of the Government Code of the State of California for the
purpose of proposing the annexation of below described property to the Costa
Mesa Sanitary District.
2. That the territory proposed to be annexed contains 78.87 acres and
is contiguous to the Costa Mesa Sanitary District and the territory proposed to
be included in and annexed to said Sanitary District is specifically described
in Exhibit "A" which is attached hereto and made a part hereof, consisting of
one typewritten sheets and a map.
3. That a map showing said boundaries together with a copy of the above
legal description has heretofore been filed with the Orange County Surveyor and
with the Commission and has been found to be definite and certain by the Orange
County Surveyor. Said map is hereby referred to and by reference made a part
hereof to the same force and effect as if set out herein or attached hereto.
4. That the territory proposed to be annexed is uninhabited.
5. That the reason for the proposed annexation is to obtain and provide
sewer service for the territory proposed to be annexed.
6. That the territory to be annexed is entirely located within Orange
County, California.
7. That the names of all the affected districts are as follows:
County Sanitation District No. 7
Orange County Flood Control District
Harbor District
Mosquito Abatement District
County Library District
Metropolitan water District
Santa Ana School District
8. That the Board of Directors of the Costa Mesa Sanitary District
respectfully requests the Local Agency Formation Commission of Orange County,
California, to institute proceedings for the annexation of the above
described territory.to said District.
9. That it is further requested that the said Local Agency Formation
Commission order pursuant to the provisions of Section 56261 of the Government
Code of California that this annexation be approved without notice and hearing
by the Commission and approve and authorize the Board of Directors of the
Costa Mesa Sanitary District to annex such territory without -notice and
hearing by the Board of Directors and without election.
10. That attached hereto is evidence of consent and request directed
to the Costa Mesa Sanitary District signed by all of the owners of the land
which is in such territory proposed to be annexed`
11. That the owners who signed said attached consent and request are
hereby found to be the owners of 100% of the land described above.
12. That the proposed terms and conditions to which the proposed
annexation is desired to be subject are described as follows:
That all annexation fees be paid to the District prior to this
annexation becoming effective.

REVISED
That portion of the land allotted to James McFadden in the City of Costa Mesa,
County of Orange, State of California, as described in the final decree of
Partition of the Rancho Santiago de Santa Ana, a certified copy of which was
recorded September 12, 1968 in book "B ", page 410 of Judgements of the District
Court in and for Los Angeles County, California, more particularly described
as follows:
Beginning at the center line intersection of Sunflower Avenue and San Leandro
Lane (formerly Smalley Road), said intersection also being the northeast corner
of Engineers No. 115 Annexation to the Costa Mesa Sanitary District; thence
departing said corner along the center line of said San Leandro Lane and the
east boundary of said Annexation South 000 51' 05" East, 2092.41 feet to the
true point of beginning; thence departing said center line and said boundary
North 890 35' 13" East, 676.21 feet to the southwest corner of Engineers No.144
Annexation to said District, said corner also being a point in the existing
westerly boundary of Tract No. 7718, as shown on a map recorded in book 303,
page 35 through 40, inclusive of Miscellaneous Maps, records of said Orange
Count -,- t?lence departi na said District boundary said tract boundary South
000 51' 05" East, 84.00 feet to an angle point therein; thence South 550 45 20"
East, 166.72 feet to the most southerly corner of said tract, said corner being
on a curve concave southeasterly, having a radius of 840.00 feet, a radial line
to said point bears North 380 29' 40" West; thence northeasterly along said curve
through a central angle of 380 04' 53 ", an arc distance of 558.30 feet to the
tangent intersection with the southerly line of the existing boundary of said
Engineers No'. 114 Annexation; thence along said tract and said southerly line
North 890 35' 13" East, 679.46 feet to the southeasterly corner of said tract
and said Engineers No. 144 Annexation; thence departing said tract and said
District boundary and continuing North 890 35' 13" East, 648.85 feet to a point
in the center line of Bear Street,' said point also being on the westerly boundary
of Engineers No. 100 Annexation to said District; thence along said center line
and said boundary South 000 48"30" East, 1309.47 feet thence departing said
center line and said boundary South 890 35' 13" West, 447.29 feet to an angle
point in the existing boundary of Engineer's No. 98 Annexation to said District;
thence along said existing boundary as created by Engineers No. 98 Annexation,
Engineer's No. 76 Annexation and Engineer's No. 115 Annexation through the follo-
ing courses; South 890 35' 13" West, 2212.09 feet and North 00 51' 05" West,
1309.47 feet to the True Point of Beginning.
Area contains 78.87 acres.
