Reso 1979-331RESOLUTION NO. 79 -331 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT, ORANGE COUNTY, CALIFORNIA, OPPOSING SOLID WASTE MANAGEMENT USER FEES AND EX- PRESSING REASONS IN SUPPORT THEREFOR. THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT, ORANGE COUNTY., CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the.Revenue Search Committee, through the office of the Auditor - Controller for the County of Orange, has proposed a solid waste management user fee for the use of new and existing land fill refuse disposal areas; and WHEREAS, said fee if imposed upon the Costa Mesa Sanitary District would of necessity be passed on to resi- dential homeowners within the District as part of the annual charge authorized by the Assessment District; and WHEREAS, if said solid waste management user fee were imposed upon the contract trash hauler for the Costa Mesa Sanitary District, the same would by contractual terms be reimbursed by Costa Mesa Sanitary District and passed on as a part of the charges authorized by the Assessment District to the residential homeowners within the District; and WHEREAS, said solid waste management user fee would constitute an unreasonable and unfair burden upon residential homeowners within the District; NOW, THEREFORE, BE IT RESOLVED THAT the Costa Mesa Sanitary District is opposed to any imposition of the solid waste management user fee by the County of Orange for the use of land fill solid waste disposal sites; -1- AND BE IT FURTHER RESOLVED THAT the Costa Mes? Sani- tary District believes said solid waste ma;-iagement user fee as proposed by the County of Orange to be inherently unfair and an unreasonable burden upon the homeowners within the Costa Mesa Sanitary District; AND BE IT FURTHER RESOLVED THAT inasmuch as the Sanitation Districts of the County propose to operate the solid waste land fill disposal sites without cost to the County, for County -wide benefit and with Sanitation Dis- trict personnel on Sanitation District payrolls, said solid waste management user fee should be unnecessary. BE IT FURTHER RESOLVED THAT any consideration of solid waste management user fees at this time is premature and should not be considered until the feasibility of a transfer station in the South Coast region has been fully explored and acted upon by the County Division of Solid Waste Management as suggested by the Orange County Solid Waste Management Plan mandated by the Nejedly - Z'derg -Dills Solid Waste Management and Resources Recovery Act. BE IT FURTHER RESOLVED THAT the Orange County Board of Supervisors direct the General Services Agency for the County of Orange to continue to explore the feasibility of a transfer station in the South Coast region prior to any consideration of any solid waste management user fee. BE IT FURTHER RESOLVED THAT the Costa Mesa Sanitary District urges the County of Orange to upgrade the quality and condition of its equipment prior to consideration of the imposition of any solid waste management users fee. MPAI BE IT FINALLY RESOLVED THAT a copy of this RESOLUTION be 'forwarded to the office of the Auditor - Controller for the County of Orange to the attention of the Revenue Research Committee considering solid waste man p agement user fees.
