Reso 1978-3211 2 3 4 51 6 7 n 9 10 11 12 13 14 15 16 17 18 19 20 21 22 RESOLUTION NO. 78 -321 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT, ADOPTING A CONFLICT OF IN- TEREST CODE APPLICABLE TO THE MEMBERS OF THE BOARD OF DIRECTORS, PURSUANT TO THE POLITICAL REFORM ACT OF 1974. THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT DOES HEREBY RESOLVE AS FOLLOWS: THAT, WHEREAS, by initiative measure the Policial Reform Act of 1974 was duly adopted and is now codified under Title 9, Chapters 1 through 11, §81000 through and including §91000 Cali- fornia Government Code; and WHEREAS, the Costa Mesa Sanitary District is an agency as defined by §82003 Government Code and is governed by the provisions of said Political Reform Act of 1974; and WHEREAS, District is required, pursuant to §87300 Government Code to enact a Conflict of Interest Code; and WHEREAS, the Board of Supervisors is, pursuant to §82011 (b), the Code reviewing body; and WHEREAS, said District has no employees and is operated pur- uant to contract with the City of Costa Mesa; and WHEREAS, the Board of Directors of the Costa Mesa Sanitary istrict in compliance with the aforesaid Government Code sections 2311adopts a Conflict of Interest Code and incorporates by reference 24 the Conflict of Interest Code of the City of Costa Mesa, required 25 pursuant to §87300 Government Code, insofar as the same shall 26 affect employees performing services under said contract for the 27 Costa Mesa Sanitary District; 2811 NOW, THEREFORE, BE IT RESOLVED: 29 SECTION 1: ADOPTION OF CONFLICT OF INTEREST CODE 30 In compliance with §87300 of the California Government 31 Code the Board of Directors of the Costa Mesa Sanitary District 32 hereby adopts this Conflict of Interest Code. -1- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 SECTION 2: APPLICATION OF CODE This Conflict of Interest Code shall be applicable to members of the Board of Directors acting in their governing capa- city for the Costa Mesa Sanitary District, and those members of the City staff of the City of Costa Mesa as shall be required to report pursuant to the Conflict of Interest Code required to be adopted by the City of Costa Mesa, pursuant to §87300. SECTION 3: DISCLOSURE Members of the Board of Directors are required pursuant Ito Government Code §87300 to disclose investments, interests in real property and income. No other or no additional disclosure requirements are imposed by this Conflict of Interest Code. a) Members of the Board of Directors shall file their statement of financial interests with the Secretary of the Board of Directors who shall make and retain a copy and forward the original to the Clerk of the Orange County Board of Supervisors. b) Members of the Board of Directors shall file an linitial statement of financial interests within 30 days after the effective date of this Code. Said statements shall disclose only investments and interests in real property held on the effective date of this Code. c) Annual statements disclosing investments, interests in real property and income shall be filed during the month of January. Such statements shall cover the period of the preceding calendar year. d) Directors appointed or elected subsequent to the leffective date of this Code shall file initial statements not less than 10 days before assuming office, unless an earlier assumption of office is required by emergency circumstances, in which case the statement shall be filed within 30 days thereafter. e) The manner of reporting investments, interests in real property and income shall be as set forth in California -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Government Code §87206 and 87207. SECTION 4: CIRCUMSTANCES REQUIRING DISQUALIFICATION Any members of the Board of Directors must disqualify himself or herself from making or participating in the making of any decision which will forseeably have a material financial af- fect, distinguishable from its effect on the public generally, on. any economic interest as defined by Government Code §87103. No member shall be prevented from making or participating in the making of any decision to the extent his or her participation is legally required for the decision to be made. SECTION 5• District has no employees and is operated by the City of Costa Mesa under the terms of an annual contract. The City of Costa Mesa employees operating the District will be governed by the Conflict of Interest Code adopted pursuant to §87300 Government Code, and this Code is adopted herewith by reference. SECTION 6: DEFINITIONS Except as otherwise indicated, the definitions contained in the Political Reform Act of 1974 (Government Code §81000 et seq.) and regulations adopted pursuant thereto are incorporated into this Conflict of Interest Code. SECTION 7: The Clerk of the District is directed to forward a certi- fied copy of this Resolution to the Orange County Board of Super- visors.
