Minutes - Board - 2016-08-16 ON 1 25 _ A y' \I- A� COSTA MESA SANITARY DISTRICT MINUTES OF BOARD OF DIRECTORS STUDY SESSION AUGUST 16, 2016 CALL TO ORDER The Board of Directors of the Costa Mesa Sanitary District met in study session on August 16, 2016 at 9:30 A.M. at 290 Paularino Avenue, Costa Mesa, CA 92626. ROLL CALL DIRECTORS PRESENT: Michael Scheafer, Robert Ooten, Arlene Schafer, James Ferryman DIRECTORS ABSENT: Arthur Perry STAFF PRESENT: Scott Carroll, General Manager; Robin Hamers, District Engineer; Alan Burns, District Counsel; Noelani Middenway, District Clerk; Wendy Davis, Finance Manager; Ed Roberts, Code Enforcement Officer; Elizabeth Pham, Management Analyst II; Gina Terraneo, Management Analyst I. OTHERS PRESENT: Dean Ruffridge, CR&R; Mary Bradley, Trendzitions; Jim Mosher, resident; and Luke Money, Daily Pilot. PUBLIC COMMENTS President Scheafer opened public comments. Jim Mosher, a member of the public, provided comments regarding the District's website and the accessibility of information about the upcoming election. Additionally, Mr. Mosher suggested that the District display its wastewater rate comparison more prominently on its website. Secretary Ooten commented that the District should focus its rate comparison on agencies similar to the District. Director Ferryman commented regarding Newport Beach's waste collection rate. ITEMS OF STUDY 1. Organics Recycling Tonnages — FY2016-17 Recommendation: That the Board of Directors receive and file the report. Elizabeth Pham, Management Analyst II, reported that a total of 742.41 tons of organic waste was collected in the month of July 2016. Secretary Ooten requested that staff include the previous year's organic tonnages in future reports. There were no further questions or comments and the Board of Directors received and filed the report. 2. Code Enforcement Officer Report— July 2016 Recommendation: That the Board of Directors receive and file the report. Ed Roberts, Code Enforcement Officer, provided report details and noted that there were 9 scavenging investigations and 92 notices issued for trash carts in public view. There were no questions or comments and the Board of Directors received and filed the report. 3. Alkaline Battery Recycling Program 2016-17 Recommendation: That the Board of Directors receive and file the report. Gina Terraneo, Management Analyst I, provided an overview of the upcoming Alkaline Battery Recycling Program. Assistant Secretary Schafer suggested that staff utilize the newspaper to publicize the program. Secretary Ooten suggested that staff notify the Newport-Mesa school board of the upcoming program. There were no additional questions or comments and the Board of Directors received and filed the report. 4. 290 Paularino Avenue — Award Tenant Improvement Contract to Kinney Construction in the amount $750,308 Recommendation: That the Board of Directors award a contract to Kinney Construction in the amount of$750,308. COSTA MESA SANITARY DISTRICT PAGE 3 MINUTES OF THE BOARD OF DIRECTORS STUDY SESSION HELD AUGUST 16,2016 Scott Carroll, General Manager, presented the bid results for tenant improvements 9 , p at 290 Paularino. He noted that the lowest bidder was disqualified for not submitting the required subcontractor's list. Discussion followed regarding the Request for Proposal (RFP) process. President Scheafer opened public comments. Mr. Mosher commented about the disqualification of contractors due to not meeting RFP requirements. President Scheafer closed public comments. Secretary Ooten made a motion to award the contract to Kinney Construction in the amount of $750,308. Assistant Secretary Schafer seconded the motion. The vote passed, 4-0-1, with Vice President Perry absent. There were no additional questions or comments and the Board of Directors received and filed the report. 5. Authorize the filing of a Writ of Mandate or Other Action to Correct False or Misleading Statements or Statements That Are Inconsistent with Election Law in the Elections Materials Submitted in Favor of the Advisory Vote on Consolidation by the Mesa Consolidated Water District Closed Session to Meet with Legal Counsel (if necessary) Initiation of litigation (Government Code section 54956.9(d)(4)- One case Alan Burns, District Counsel, presented the public announcement to file a Writ of Mandate or other action to correct false or misleading statements or statements that are inconsistent with election law in the elections materials submitted in favor of the advisory vote on consolidation by the Mesa Consolidated Water District. Assistant Secretary Schafer provided comments regarding the Orange County Board of Supervisors meeting that she and Mr. Carroll attended on August 9, 2016. Discussion followed regarding the legality of using the advisory vote measure's language in campaigning efforts. President Scheafer opened public comments. Mr. Mosher commented that Mesa Water District's study indicates that consolidation is not necessarily a prerequisite to providing ratepayer savings. President Scheafer reconvened to open session at 10:33 A.M. He noted that the Board of Directors directed staff to file the Writ of Mandate. There were no additional questions or comments. 6. Future Study Session Items Recommendation: That the Board of Directors provide staff with direction on items to be placed on future study session agendas. There were no future study session items discussed. ORAL COMMUNICATIONS AND DIRECTORS COMMENTS -NONE ADJOURNMENT There being no further business to come before the Board, President Scheafer adjourned the meeting at 10:34 A.M.
