Code Enforcement Officer Report – June 2016 Recommendation: That the Board of Directors receive and file the report. Ed Roberts, Code Enforcement Officer, provided report details and noted that there were 6 scavenging investigations concentrated on the West side of Costa Mesa and 80 cases of trash carts in public view. There were no additional questions or comments and the Board of Directors received and filed the report. 3. Art Wrap Contest – Update Recommendation: That the Board of Directors receive and file the report. Gina Terraneo, Management Analyst I, provided an update regarding the upcoming Art Wrap Contest. She noted that 6 local high schools and colleges will be contacted to publicize the contest at the start of the 2016-2017 school year. Discussion followed regarding reaching out to Early College High School in addition to the listed schools. There were no additional questions or comments and the Board of Directors received and filed the report. 4. Quarterly Legislative Analysis Recommendation: That the Board of Directors receive and file the report. Ms. Terraneo presented the Quarterly Legislative Analysis and provided an overview of the California Special Districts Association (CSDA) Legislative Days Conference on May 16-17. Additionally, she noted that staff recommends supporting AB 2022, SB 1292, and HR 3353, and opposing SB 1170. There were no additional questions or comments and the Board of Directors received and filed the report. 5. Closed Circuit Television (CCTV) Sewer Lateral Program Recommendation: That the Board of Directors direct staff to bring the CCTV Sewer Lateral Program to the July 28, 2016 Board meeting for consideration. Ms. Terraneo provided an overview of the proposed CCTV Sewer Lateral Program and presented the proposed program application. Discussion followed regarding the intent of the program, problems that may arise from the program’s design, and the possibility of going out to bid for a limited number of plumbers to participate in the Pilot Program. Proposed West Side Pump Station and Force Main Improvements Recommendation: That the Board of Directors direct staff to bring this item back to the July 28, 2016 Board of Directors meeting to approve the District Engineer’s budget to refurbish five sewer pump stations. Robin Hamers, District Engineer, provided report details and presented long and short term planned improvements to rehabilitate pump stations and force mains. Discussion followed regarding the time frame for the proposed improvements and the effects of withdrawing from the 6-19 South West Costa Mesa Trunk Sewer project. The Board of Directors directed staff to proceed with sending a letter to Jim Herberg, General Manager of the Orange County Sanitation District (OCSD), and requesting a meeting to negotiate a settlement. There were no additional questions or comments. 7. Tour of CR&R’s Anaerobic Digestion Facility in the City of Perris, California – Oral Report Recommendation: That the Board of Directors set a date to tour CR&R’s anaerobic digestion facility in the City of Perris, California and direct staff on the planning phase. Mr. Carroll shared staff’s recommendation to select a date and develop a plan to tour the anaerobic digestion facility. Discussion followed regarding attending the tour while remaining compliant with the Brown Act, the coordination of transportation, and the need for an RSVP process. The Board of Directors directed staff to coordinate a tour date in September, to post the tour as public meeting, and to invite the public. Additionally, the Board of Directors directed staff to rent a van to transport Board Members to the facility. There were no additional questions or comments. 8. Reschedule August 9, 2016 Study Session and Consider Hosting the Meeting at 290 Paularino Avenue, California – Oral Report Recommendation: That the Board of Directors provide staff with direction. Solid Waste Association of North America (SWANA) WASTECON and Awards Breakfast in Indianapolis, Indiana Recommendation: That the Board of Directors considers sending representatives from CMSD to SWANA WASTECON in Indianapolis, Indiana to receive the Silver Excellence Award in the Integrated Solid Waste Management System category. Mr. Carroll presented the costs associated with sending representatives from CMSD to accept the Silver Excellence Award at SWANA WASTECON. Discussion followed regarding Board Member schedules and the benefits of attending the awards breakfast. The Board of Directors directed President Scheafer and Ms. Terraneo to attend SWANA WASTECON for the awards breakfast on August 23, 2016. There were no further questions or discussion. 10. Future Study Session Items Recommendation: That the Board of Directors provide staff with direction on items to be placed on future study session agendas. President Scheafer requested that staff provide an update regarding the Alkaline Battery Recycling Program at the August 16, 2016 Study Session. There were no further questions or discussion. Sewer Lateral Assistance Program (SLAP) Update 10. Resolution No. 2016-890 Ordering that Publication of Ordinance No. 115 Confirming Annual Charges for Solid Waste and Wastewater for 2016-17 has Occurred Directors’ Compensation and Reimbursement of Expenses for June 2016 as presented. The Board of Directors approved the SLAP report as presented. The Board of Directors adopted Resolution No. 2016-890. Director Ferryman made a motion to approve the Consent Calendar as presented. Vice President Perry seconded the motion, which passed unanimously with a 5-0 vote. There were no further questions or comments. END OF CONSENT CALENDAR NEW BUSINESS 24. Mesa Water District Optimal Governance Structure Study Recommendation: That the Board of Directors discuss the study and provide direction to staff. District Treasurer, Marc Davis, provided a review of the study. Mr. Davis commented that he has concerns regarding the objectivity of Arcadis U.S. Inc., provided that Arcadis U.S. Inc. has conducted other studies and projects for Mesa Water District in past years. Secretary Ooten indicated that he has concerns with changes that were made to the line cleaning portion of the study. General Manager, Scott Carroll, requested that the Board of Directors refrain from questions and comments until Mr. Davis concludes his presentation. Mr. Davis presented several sources of concern within the study, including the use of financial statements from 2015 and the lack of consideration of changes made to the District’s biennial budget since its adoption in 2015. He clarified that Mesa Water District’s AAA credit rating is in reference to their bonds rather than a rating of their agency as a whole. Mr. Davis also shared that the District has an asset replacement plan that is based upon a 35-year rolling look ahead to plan necessary infrastructure improvements. In terms of real estate, he noted that the study proposes that Mesa Water District’s current headquarters has sufficient space to house a consolidated COSTA MESA SANITARY DISTRICT PAGE 4 MINUTES OF THE BOARD OF DIRECTORS REGULAR MEETING HELD JULY 28, 2016 ______________________________________________________________________ agency; however, Mesa Water District’s Board of Directors held a closed session meeting to discuss acquiring the property next door to its headquarters in May of 2016. Mr. Davis addressed the financial management portion of the study and indicated that the estimated one-time and annual savings calculations are flawed and should not be relied upon to make informed decisions about whether the two agencies should be consolidated. He added that the study’s data was used by Mesa Water District’s Board of Directors in a decision to submit an advisory ballot measure during their July 28, 2016 Special Meeting. Secretary Ooten read the advisory ballot measure that was passed at Mesa Water District’s July 28, 2016 Special Board Meeting. Discussion followed regarding the language used in the advisory ballot measure and the possibility of challenging the advisory ballot measure. Additionally, discussion followed regarding Mesa Water District’s debt and the proposed service area of a consolidated agency. President Scheafer noted that Mesa Water District does not currently serve the area of Santa Ana Heights, while the District does serve this area. Vice President Perry asked when the deadline for the advisory ballot measure and all responses were due. District Clerk, Noelani Middenway, noted that they are due on August 12, 2016. Finance Manager, Wendy Davis, provided commentary regarding Mesa Water District’s financial status. Discussion followed regarding the proposed service area, the proposed organizational structure of a consolidated agency, and possible Brown Act violations regarding the Mesa Water District Board of Director’s decision to initiate a study. Mr. Carroll suggested that the Board of Directors approve the formation of an Ad Hoc Committee containing two Board Members to meet with District staff and consultants in regards to the District’s public relations. President Scheafer opened public comments and invited Jim Mosher, a member of the public, to speak. Mr. Mosher provided commentary regarding the advisory ballot measure. President Scheafer closed public comments. Mr. Carroll asked if an Ad Hoc Committee could provide staff with direction to proceed with proposed actions. Vice President Perry made a motion to establish an Ad Hoc Committee including President Scheafer and Secretary Ooten (and Vice President Perry as an alternate) to meet with staff and consultants in regards to the District’s public relations and Mesa Water’s proposed consolidation. As required by the District’s Statement of Investment Policy, the Investment Report delineates all investment activity during the month. Staff Recommendation Approve the Investment Report for the month of July 2016. Analysis This report lists the types of securities held in the District’s portfolio, the institutions from which the securities were purchased, maturity dates and interest rates as of July 31, 2016. The District’s investments are in compliance with the Statement of Investment Policy adopted by the Board at the June 23, 2016 regular meeting, as well as the California Government Code. The market values in this report were provided by our third party custodian, Pershing, LLC, except for the Local Agency Investment Fund (LAIF). The market value of LAIF was provided by the State Treasurer’s Office. It does not represent the value of the underlying securities within the pool, but rather the par or cost amount, which is the amount the District is entitled to withdraw. This reporting practice is consistent with industry standard practices for similar funds. The weighted average stated rate of return (current yield) for the District’s investment portfolio as of July 31, 2016, was 1.131%. The yield to maturity of the portfolio was 1.136%. The District’s weighted average interest rate was 54 basis points (0.543%) above the LAIF average monthly rate for July 2016 of 0.588%. The weighted average number of days to maturity for the District’s total portfolio was 926 days (2.54 years). The average duration of the underlying securities in LAIF as of July 31, 2016 was 166 days. Board of Directors August 25, 2016 Page 2 of 2 The District’s investment portfolio is in compliance with its liquidity limitations, which requires that a minimum of 20.00% of the portfolio must mature within one year. The percentage of the portfolio maturing in less than one year as of July 31, 2016 was 40.88%. The District has adequate cash reserves necessary to meet its obligations for the next six months. As of July 31, 2016, the percent of portfolio invested in money market mutual funds was 11.11%, which exceeded the limit of 10.00%. This temporary instance of non-compliance was due to investment calls and maturities for which new investments had not yet settled. This temporary instance of non-compliance will be removed when the new investments settle during August 2016. Strategic Plan Element & Goal This item supports achieving Strategic Element No. 7.0, Finances, by ensuring the short and long-term fiscal health of the District. Legal Review Legal review is not required. Environmental Review Subject activity is exempt from the requirements of the California Environmental Quality Act (CEQA) (Public Resources Code Section 21000 et. seq.). Section 15300.4 of CEQA allows an agency while establishing its own procedures “to list those specific activities which fall within each of the exempt classes”, and the District has adopted “CEQA Guidelines and Implementing Procedures” that state on page 6, “”Projects” does not include….C. Continuing administrative or maintenance activities.” Financial Review The portfolio was budgeted to earn an average rate of 0.900% for the year ending June 30, 2017. Through July 31, 2016, the portfolio has earned a weighted average interest rate of 1.131%. Project No. 101 was part of a joint project with Orange County Sanitation District (OCSD) where OCSD would construct a new trunk in Talbert Regional Park and underneath the Santa Ana River that will enable CMSD to construct gravity pipeline and abandon the five pump stations. Due to unexpected cost increases from OCSD’s project and the risk and uncertainty of boring underneath the Santa River, OCSD staff is not recommending this project be continued. On August 24, 2016, OCSD Board of Directors will be considering suspending this project indefinitely and reimbursing CMSD for costs that have incurred for Project No. 101. Staff Recommendation That the Board of Directors approve the following: 1. Transfer $1,467,000 from Project 101 to Project 317; and 2. Appropriate the estimated $192,128 from OCSD when received to Project 317; and 3. Direct staff to request the additional appropriation of approximately $1,500,000 at the time the construction contract is submitted for approval to the Board. Analysis Project No. 101 would consist of constructing gravity flow pipeline connected to OCSD’s new trunk in Talbert Regional Park and underneath the Santa Ana River where the wastewater would travel to OCSD’s Treatment Plant 2 in Huntington Beach and treated to industry standards. The following CSMD pump stations were planned for abandonment. Board of Directors August 25, 2016 Page 2 of 3 1. Canyon 3. Sea Bluff 5. 19th Street 2. President 4. West Bluff Due to unexpected cost increases from OCSD’s project and the risk and uncertainty of boring underneath the Santa River, OCSD staff is not recommending this project be continued. On July 12, 2016, District Engineer, Rob Hamers, presented to the Board a cost estimate to refurbish the five pump stations and their force mains. The total cost was over $6 million in which half of the total cost is for President Pump Station and force main. Attachment A is a copy of the July 12th staff report. The Board accepted the District Engineer’s cost estimate but did not appropriate funds or direct staff to proceed with the refurbishments until OCSD officially suspends their project and approves reimbursing CMSD for costs that occurred for Project No. 101. On August 24, 2016, OCSD Board of Directors will be considering suspending their project indefinitely and approving reimbursing CMSD for costs that incurred from 2006 to 2016 in the amount of $192,127.79. Attachment B is support documentation for CMSD’s costs on Project No. 101. On July 27, 2016, CMSD management met with CMSD maintenance workers to discuss refurbishing the five pump stations and their force mains and prioritize their order of completion. Staff agreed that President’s force main be refurbished first followed by the pump station. After President, staff agreed that Canyon, 19th Street, West Bluff and Sea Bluff force mains should be refurbished in that order followed by refurbishing the pump stations. Tonight staff will report OCSD Board of Directors action and if they approve suspending their project and reimbursing CMSD then staff is recommending you approve staff recommendations mentioned above. Without OCSD’s participation, the Costa Mesa Sanitary District (CMSD) faces significant additional costs to abandon the west side pump stations and force mains, therefore, the District will retain the pump stations and force mains and develop a budget for appropriate rehabilitation and replacement of these facilities. Staff Recommendation That the Board of Directors direct staff to bring this item back to the July 28, 2016 Board of Directors meeting to approve the District Engineer’s budget to refurbish five sewer pump stations. Analysis Orange County Sanitation District re-analyzed the construction costs of the proposed 6-19 trunk sewer and determined the cost would increase from $15 million to $28 million with the project beginning construction in the year 2021. Additionally, the abandonment concept results in redirection of CMSD flows away from OCSD Plant #1 Board of Directors July 12, 2016 Page 2 of 3 where wastewater recycling occurs, which conflicts with OCSD’s intent to further increase wastewater recycling. Finally, additional study on OCSD’s Fairview Trunk sewer discloses that with further reductions in inflow and infiltration (I/I), the Fairview Trunk will not require upsizing. It was previously believed the 6-19 project was needed to remove I/I from the Fairview Trunk or it would have required upsizing. For these reasons, OCSD is no longer in support of the 6-19 project. An attempt by CMSD to abandon the west side pump stations under Project #101 without participation by OCSD would result in CMSD not only spending $7.1 million to abandon five of the stations, but the District would also have to construct a new, large pump station in Talbert Park and take over and upsize the City of Newport Beach force main that traverses the park and pumps towards Plant #1. The new pump station, force main, and park restoration costs represent millions of dollars of additional improvements CMSD would incur thereby pushing CMSD’s total costs well over $10 million. The alternative to spending over $10 million is to have the pump stations and force mains remain in service and to perform rehabilitation and replacement in appropriate time frames. In this regard, engineering and maintenance staff compiled a list of near term and long term improvements for the pumping stations that will remain. Those costs are shown below. Community surveys provide valuable input from citizens/residents regarding their level of satisfaction with the services provided by CMSD. The last such survey was performed in 2012. The Board did not schedule a special meeting because you wanted to wait for further implementation of the Organics Recycling Program and therefore directed staff to perform the survey in the fall. Staff Recommendation That the Board of Directors direct staff to begin soliciting bids to perform a community outreach survey. Analysis Community surveys are great tools to measure CMSD performance and service delivery by obtaining feedback from citizens/residents. It’s also a great opportunity for citizens/residents to give us their input on the quality of life in the community and ideas on how to improve it. In 2012, CMSD hired a professional opinion research and strategy firm to conduct 1,000 telephone interviews regarding the services provided by CMSD, but the services were related to solid waste only. Staff believes the next survey should include all the services provided by CMSD. I have reason to believe that this project or those persons involved in that project may have the need for District engineering approvals in the future. I have been retained by Kim McCartney and will be reporting this relationship as a source of income on my FPPC Statement of Economic Interests Form 700 next year. Regional Water Quality Control Board litigation. The Board has already authorized this litigation, this request merely asks approval to pay the cost of the record which is necessary to proceed to trial. Staff Recommendation That the Board of Directors approves paying the administrative record cost of $7,070.00 Analysis CMSD has challenged the decision of the Regional Water Quality Control Board (RWQCB) imposing a fine on CMSD arising out of the sanitary sewer overflows at Irvine Pump Station on August 31, 2013 and from the Indus pipeline on January 1, 2015. To challenge that fine, the District was required to file a Petition for Administrative Mandamus. The trial in a Petition for Administrative Mandamus is based on the record produced in a lower tribunal. In this case, the lower tribunal was the hearing conducted before the RWQCB, which occurred at the Irvine Ranch Water District (IRWD) headquarters. The record has now been prepared and we have received an itemized bill for those services (attached). Although Respondent (RWQCB) is responsible for preserving and creating the record, the Petitioner (CMSD) is responsible for paying for the cost of preparing the record in the first instance. If we prevail, we are entitled to be recover our “costs” which include Board of Directors August 25, 2016 Page 2 of 2 the cost to prepare the record. Of course, if we do not prevail, we will not recover those costs. The cost for the record is $7,070 as shown on the attached invoice. We also ask for an additional sum to obtain a hard copy, which is what the court wants; however, the sum is unknown at this time. PLAINTIFF operates the sewage collection lines for the City of Costa Mesa and parts of Newport Beach and the County of Orange. PLAINTIFF is under an obligation to keep its lines open and flowing so as not to cause a sewer system overflow that causes raw sewage to escape and create a health hazard and is also under an obligation under federal and state law not to allow raw sewage to enter the waters of the United States, which includes any discharge into gutters and storm drains that ultimately flow into the Pacific Ocean. District regularly cleans its lines to ensure that sewage continues to flow unrestricted so there is not a sewer system overflow. 4. Sometime in 1992 or thereafter DEFENDANT operating through its Department of Transportation (Caltrans) undertook a street widening project and pursuant to that undertaking, hired a contractor to construct the street widening, including relocating street lights and traffic signal controllers. As part of that project, or as part of another project, DEFENDANT hired a contractor who installed a street light pole # 003A015 in such a manner that it pierced the PLAINTIFF’s sewer line at or near 2285 Newport Blvd, post mile 2-854. DEFENDANT’s contractor never advised the District that it had damaged the PLAINTIFF’s sewer line but instead fabricated a repair that left the street light base in the PLAINTIFF’s line, and repaired the damage by placing a smaller diameter pipe inside PLAINTIFF’s line and connecting the two larger pipe ends to this smaller diameter pipe.
