A RESOLUTION OF THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT,
ORANGE COUNTY, CALIFORNIA, MAKING APPLICATION TO THE LOCAL AGENCY
FORMATION COMMISSION OF ORANGE COUNTY, CALIFORNIA, FOR THE ANNEXATION OF
TERRITORY TO THE DISTRICT,
THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT, ORANGE COUNTY,
CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
WHEREAS, the Board of Directors of the Costa Mesa Sanitary District,
Orange County, California, desires to initiate proceedings for the annexation
of the hereinafter described territory to said District;
NOW, THEREFORE, the Board of Directors of the Costa Mesa Sanitary District
of Orange County, California, does hereby resolve, determine and order as
follows:
1. That this application is being filed pursuant to the provisions of
Division 1 of Title 6 of the Government Code of the State of California for the
purpose of proposing the annexation of below described property to the Costa
Mesa Sanitary District.
2. That the territory proposed to be annexed contains 23.234 acres and
is contiguous to the Costa Mesa Sanitary District and the territory proposed to
be included in and.annexed to said Sanitary District is specifically described
in Exhibit "A" which is attached hereto and made a part hereof, consisting of
two typewritten sheets and a map.
3. That a map showing said boundaries together with a copy of the above
legal description has heretofore been filed with the Orange County Surveyor and
with the Conunission and has been found to be definite and certain by the Orange
County Surveyor. Said map is hereby referred to and by reference made a part
hereof to the same force and effect as if set out herein or attached hereto.
4. That the territory proposed to be annexed is uninhabited.
5. That the reason for the proposed annexation is to obtain and provide
sewer service for the territory proposed to be annexed.
6. That the territory to be annexed is entirely located within Orange
County, California.
7. That the names of all the affected districts are as follows:
County Sanitation District No. 7
Orange County Flood Control District
Harbor District
Mosquito Abatement District
County Library District
Metropolitan Mater District
Santa Ana School District
8. That the Board of Directors of the Costa Mesa Sanitary District
respectfully requests the Local Agency Formation Commission of Orange County,
California, to institute proceedings for the annexation of the above
described territory,to said District.
9. That it is further requested that the said Local Agency Formation
Commission order pursuant to the provisions of Section 56261 of the Government
Code of California that this annexation be approved without notice and hearing
by the Commission and approve and authorize the Board of Directors of the
Costa Mesa Sanitary District to annex such territory without notice and
hearing by the Board of Directors and without election.
10. That attached hereto is evidence of consent and request directed
to the Costa Mesa Sanitary District signed by all of the owners of the land
which is in such territory proposed to be annexed,
11. That the owners who signed said attached consent and request are
hereby found to be the owners of 100% of the land described above.
12. That the proposed terms and conditions to which the proposed
annexation is desired to be subject are described as follows:
That all annexation fees be paid to the District prior to this
annexation becoming effective.

A parcel of land being a portion of Section 33, Township 5 South, Range 10 West
in the land allotted to James McFadden in decree of partition of the Rancho
Sanitago de Santa Ana, rendered in Case No. 1192 and entered in Book "B ", page
410 of Judgments of the 17th Judicial District Court of California in the City
of Costa Mesa, County of Orange, State of California, more particularly
described as follows:
Beginning at an angle point in the existing boundary of the Costa Mesa
Sanitary District as said boundary is described in Engineers No. 121 Annexation
to said District, said angle point being South 10 13' 2.0" East, along; the center
line of Hyland Avenue as shown on a Parcel Map filed in book 33, page 36 of
Parcel Maps in the office of the County Recorder of said Orange County, 515.41
feet from the center line of Sunflower Ave. as shown on said Parcel Map; thence
South 10 13' 20" East along the center line of Hyland Ave. and said existing
boundary of the Costa Mesa Sanitary District, 833.79 feet to a point in the
northerly line of the land described in a deed to the State of California, re-
corded in book 6248, page 587 of Official Records of said Orange County; thence
departing from said existing, boundary of the Costa Mesa Sanitary District along
said northerly line, the.following courses: North 680 40' 46" West, 159.27 ft.
thence North 640 14' 11" West, 500.00 ft.; thence North 670 05' 55" West, 300.38
feet; thence North 640 17' 17" West, 2.4.03 feet; thence North l0 13' 20" West,
parallel with and distant 888.23 ft. measured at right angles, from the center
line of previously mentioned Hyland Ave., 928.94 feet to a point in the center
line of Previously mentioned Sunflower Ave.; thence North 880 51' 50" East,
along the center line of said Sunflower Ave., 888.23 feet to the center line of
said Hyland Ave.; thence South 10 13' 20" East, along said center line of
Hyland Ave., 515.41 feet to the point of beginning.
