A RESOLUTION OF THE BOARD OF DIREC'IORS OF THE
COSTA MESA SANITARY DISTRICT, ORANGE COUNTY,
CALIFORNIA, MAKING APPLICATION TO THE LOCAL
AGENCY FORMATION COMMISSION OF ORANGE COUNTY,
CALIFORNIA, FOR THE ANNEXATION OF TERRITORY
TO THE DISTRICT, BEING RZE XATION NO. 228
THE BOARD OF DIREC'T'ORS OF THE COSTA MESA SANITARY DISTRICT, ORANGE
COUNTY, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
WHEREAS, the Board of Directors of the Costa Mesa Sanitary District,
Orange County, California, desires to initiate proceedings for the annexa-
tion of the hereinafter described territory to said District;
NOW, THEREFORE, the Board of Directors of the Costa Mesa Sanitary
District of Orange County, California, does hereby resolve, determine
and order as follows:
1. That this application is being filed pursuant to the provisions
of Division 1 of Title 6 of the Government Gode of the State of California
for the purpose of proposing the annexation of below described property
to the Costa Mesa Sanitary District.
2. That the territory proposed to be annexed contains 461.2 acres
and is contiguous to the Costa Mesa Sanitary District and the territory
proposed to be included in and annexed to said Sanitary District is
specifically described in Exhibit "A" which is attached hereto and made a
part hereof, consisting of one typewritten sheets and a map.
3. That a map showing said boundaries together with a copy of the
above legal description has heretofore been filed with the Orange County
Surveyor and with the Commission and has been found to be definite and
certain by the Orange County Surveyor. Said map is hereby referred to
and by reference made a part hereof to the same force and effect as. is
set out herein or attached hereto.
4. That the territory proposed to be annexed is uninhabited.
5. That the reason for the proposed annexation is to obtain and
provide sewer service for the territory proposed to be annexed.
6. That the territory to be annexed is entirely located within
Orange County, California.
7. That the names of all the affected districts are as follows:
Orange County Sanitation District No. 7
Orange County Flood Control District
Harbor District
Mosquito Abatement District
County Library District
Metropolitan Water District
Santa Ana School District
8. That the Board of Directors of the Costa Mesa Sanitary District
respectfully requests the Local Agency Formation Commission of Orange
County, California, to institute proceedings for the annexation of the
above described territory to said District.
9. That it is further requested that the said Local Agency Fbrma-
tion Commission order pursuant to the provisions of Section 56261 of
the Government Code of California that this annexation be approved with-
out notice and hearing by the Commission and approve and authorize the
Board of Directors of the Costa Mesa Sanitary District to annex such
territory without notice and hearing by the Board of Directors and
without election.
10. That attached hereto is evidence of consent and request directed
to the Costa Mesa Sanitary District signed by all of the owners of the
land which is in such territory proposed to be annexed.
11. That the owners who signed said attached consent and request
are hereby found to be the owners of 100 percent of the land described
above.
12. That the proposed terms and conditions to which the proposed
annexation is desired to be subject are described as follows:
That all annexation fees be paid to the District prior to this
annexation becoming effective.

A parcel of land lying within Lot A.of the Banning Tract, in the
Rancho Santiago de Santa Ana, in the City of Costa Mesa, County
of Orange, State of Cal i forni a, as shown on a map of sai d Tract
filed in Action No. 6385 in the Superior Court of the State of
California, in and for the County of Los Angeles, being an action
for Partition entitled Hancock Banning, et al vs. Mary H.
Banning, more particularly described as follows:
Beginning at an angle point in the existing boundary of the Costa
Mesa Sanitary District, said point being the southwest corner of
Engineer's No. 30 Annexation to said District, said point also
being on the center 1 i ne of Harbor Bl vd; thence departing said
existing boundary S89027'30 "W 40.00 feet along the westerly
prolongation of the southerly line of said Engineer's No. 30
Annexation to the most northeasterly corner of Annexation No. 21
to said District as adopted by the Board of Supervisors on
December 27, 1955; thence westerly along the northerly line of
said Annexation No. 21 to the southeast corner of Engineer's No.
222 Annexation to said District; thence along the existing
boundary of said Engineer's No. 222 in generally northwesterly,
southwesterly, southerly, westerly and southerly direction to the
northeasterly corner of Engineer's No. 38 Annexation to said
District; thence westerly along the northerly line of said
Engineer's No. 38 Annexation to the northwesterly corner thereof;
thence departing the existing boundary of said District westerly
along the southerly line of said Lot A S89027'30 "W 102.87 feet to
the westerly boundary of the land described in Grant Deed from
the Orange County Harbors, Beaches and Parks District to the City
of Costa Mesa recorded as Instrument No. 86- 026581 of Official
Records of Orange County- thence along said westerly line the
fol 1 owing courses: N19a35'27 "E 300.28 feet; N6045'13 "E 248.06
feet; N3043'58 "E 206.93 feet; N6037'40 "E 360.32 feet; N7014'42 "E

314.88; N76035'11 "W 749.45 feet; thence continuing along said
westerly line N13024'49 "E 1075.17 feet to a point on the
southerly boundary of Engineer's No. 85 Annexation to the Costa
Mesa Sanitary District; thence easterly along the southerly
boundary of said District as described in Engineer's Nos. 85,
120, 156, and 155 Annexations to the northwest corner of
Engineer's No. 206 Annexation to said District; thence along the
existing boundary of said Engineer's No. 206 Annexation in a
generally southerly, southwesterly, southeasterly, southwesterly,
southeasterly, southwesterly, southeasterly, northeasterly,
southeasterly, northeasterly, easterly, southeasterly and
northeasterly direction to a point on the westerly boundary of
said Engineer's No. 30 Annexation; thence southerly along said
westerly boundary to the point of beginning.
The above desbribed parcel of land contains 461.2 acres.
